Protect the Right to Access Public Spaces: Reject Indiana Senate Bill 286

The Issue

I, and my community, desperately need your help!

I am an immune-compromised, disabled woman living in Indiana. For me, even something as simple as a cold can result in hospitalization. Wearing a mask is not just a preventive measure, but a vital necessity that allows me to safely partake in public life. Without this essential safeguard, participating in society becomes dangerous.

Disabled and immune compromised people deserve the same safe access to public spaces as anyone else. Senate Bill 286, authored by Senator Gary Byrne, criminalizes the wearing of masks at "public assemblies" - spaces for civic engagement, education, religious practice, social venues, recreation, and medical care facilities etc.

Breaching this law would be deemed a Class C misdemeanor (up to 60 days in jail and or $500 fine) or a Class A misdemeanor (up to a year in prison and or a $5,000 fine) for a second offense.

It's not just about me - there are many other Hoosiers whose lives are similarly at risk. We cannot afford to enforce policies that push the vulnerable further out of society. This proposed law is alarmingly regressive and discriminatory.

I urge the lndiana legislation to reject Senate Bill 286 and to prioritize public health over politics. I invite you all to stand with me in this fight for our right to health and safety.

Update 1/15/25: according to Bill Track 50, there has been some clarification which reads as follows, 

“This bill introduces new regulations regarding mask-wearing at public assemblies in Indiana, establishing clear definitions and criminal penalties. The legislation defines a "mask" as any covering that obscures a person's nose or mouth, with specific exceptions for holiday costumes, theater costumes, religious coverings, occupational safety equipment, medical devices, protective helmets, athletic equipment, and emergency medical gear. A "public assembly" is defined as a gathering of at least ten people in a public place or venue open to the general public. The bill creates a new criminal offense called "unlawful masking," which makes it a Class C misdemeanor to wear a mask at a public assembly, with the penalty increasing to a Class A misdemeanor for subsequent offenses. Additionally, the bill enhances penalties for rioting and disorderly conduct, elevating these offenses to a Level 6 felony if committed while wearing a mask. These changes aim to address potential public safety concerns and discourage individuals from concealing their identities during potentially volatile public gatherings, while still providing reasonable exceptions for mask-wearing in various legitimate contexts.”

However, the term “medical devices” seems vague at best and I will reach out for clarification as to whether or not they mean masks for medical equipment such as ventilators and oxygen concentrators or PPE. I will update you as soon as I am able.
