Should a public official face jail time for calling out bad laws?

That’s the question now facing Texas, where Sarah Stogner — the elected district attorney for the 143rd Judicial District — is under scrutiny after openly defying the state’s proposed THC ban. Earlier this month, Stogner posted a TikTok where she appeared to smoke a joint in her backyard. She says she legally bought it in New Mexico and crossed back into Texas — deliberately, and with a message: “Come and take it.”

Her protest was aimed at Lt. Gov. Dan Patrick, a key supporter of the ban. But now, she could face criminal consequences for making a statement that millions of Texans agree with: that cannabis laws in this state are broken.

In Texas, possession of marijuana — even a small amount — is still a Class B misdemeanor. But Stogner didn’t just possess it. She made it political. She challenged hypocrisy. And she made people pay attention.

Supporters of her actions say this isn’t about lawlessness — it’s about leadership. Across the U.S., cannabis is legal in 24 states and counting. Texans have already passed decriminalization measures in cities like Austin, Denton, and Elgin. And yet lawmakers in Austin are trying to crack down even harder, despite national trends, medical evidence, and public support for change.

If prosecutors go after Stogner, they’re not protecting Texas — they’re punishing dissent.

We are calling on the Texas Attorney General’s Office, the DEA, and local prosecutors to drop any attempt to investigate or prosecute Sarah Stogner for her symbolic protest. If lawmakers want to debate cannabis laws, they should do it in the open — not by threatening political opponents.

This isn’t about whether you support legalization. It’s about whether a DA should lose her career or her freedom for holding a joint and asking a question that matters to millions of Texans.
