Protect Marriage Equality in Pennsylvania — Pass the Marriage Equality Act Now

The Issue

Marriage equality is the law of the land — for now. But with the U.S. Supreme Court being asked to reconsider the ruling that secured that right nationwide, Pennsylvania cannot afford to wait.

Right now, Pennsylvania law still defines marriage as a union between “one man and one woman,” even though this outdated language was struck down in 2014. If the Supreme Court overturns Obergefell v. Hodges or weakens it through future decisions, the rights of thousands of LGBTQ families in Pennsylvania could be at risk — unless we act now.

That’s why we’re calling on the Pennsylvania State Senate to take up and pass the Marriage Equality Act, introduced by State Rep. Malcolm Kenyatta and State Sen. Carolyn Comitta. This legislation would replace the discriminatory language still on the books and formally recognize marriage in Pennsylvania as a civil contract between two individuals, regardless of gender.

The House already passed this bill with bipartisan support. But Senate Republican leadership has so far refused to even bring it up for a vote.

This is not about politics — it’s about protecting families. As Rep. Kenyatta said, “There is nothing more American than strengthening the family unit.” Right now, LGBTQ families are raising children, paying taxes, building communities — yet they still live with the uncertainty that their rights could be taken away by a single court decision.

We need clear, state-level protections. We need to finish what began in 2014 when a federal judge ruled Pennsylvania’s marriage ban unconstitutional. And we need to make sure our laws reflect the values of fairness, dignity, and family for all.

Tell the Pennsylvania Senate: Bring the Marriage Equality Act to a vote — and pass it. LGBTQ+ Pennsylvanians deserve legal certainty, not legal limbo.
