Protect Fulton County’s Sealed 2020 Election Records from Federal Overreach

The Issue

Fulton County, Georgia, is once again being dragged into the political spotlight over the 2020 election.

On December 6, 2025, the U.S. Department of Justice filed a lawsuit against Fulton County, demanding access to sealed election materials including used ballots, ballot stubs, signature envelopes, and digital files from the 2020 General Election.

We call on Fulton County officials and the Georgia courts to protect these sealed records and defend voter privacy and the rule of law.

These materials are not public documents. They are legally protected under Georgia law, and county officials have stated clearly that releasing them requires a court order. The DOJ’s lawsuit attempts to sidestep those protections, setting a dangerous precedent for political fishing expeditions into voters' confidential information.

The 2020 election was certified at the state and national level. Multiple audits and recounts in Georgia, including a hand recount, confirmed the integrity of the vote. Voter fraud claims have been fully debunked by state officials, courts, and independent observers.

Reopening sealed records from that election not only undermines public trust in the outcome but also sends a chilling message to voters who expect that their ballots will remain private and secure.

This is not just about Georgia. If the DOJ succeeds in forcing open sealed ballots in one county, it could happen anywhere. Every voter, regardless of political affiliation, should be able to cast a ballot without fear that their signature or personal voting records will be exposed years later.

We urge:

  • The Fulton County Board of Commissioners to stand firm in protecting sealed election materials
  • The Georgia judiciary to uphold existing privacy protections under state election law
