This evening, I am writing with bittersweet news to share.
On February 28, 2024, almost three years after Leonard's new discovery evidence of innocence was filed, Judge Jay A. York of the Mobile County Circuit Court denied Leonard a new trial. In short, Judge York and Assistant DA Chris McDonough were capable of reading affidavits from men who heard a full confession from the actual perpetrator, listening to them testify in open court, and still denying Leonard a new trial.
Here is what Leonard's attorney, one who has been on his Rule 32 since April 2021, had to say. "As it turns out, the judge copied the State's brief almost verbatim. I'm sick over the decision, but I'm ready to carry on. There is no question in my mind, or the minds of anyone familiar with the case, that Leonard did not kill Kimberly."
So, where do we go from here? In the coming days, Leonard's attorney will be filing our appeal with the Supreme Court of Alabama. Leonard's sentence already makes him eligible for a parole hearing in 2026. He is not fighting to simply get out of prison. He is fighting to clear his name of a crime to which someone else confessed to two other people. That person's name also happens to be one Leonard provided to Mobile Metro PD Officers Bagsby and Quinnie in 2010.
The right parties must be held accountable for a botched investigation and trial and wrongfully imprisoning a man with no prior convictions. Our plea to our supporters to help us accomplish this goal is to share this petition with those who are willing to sign it, leave a comment on it, and share on their platforms and to please feature Leonard's story in your podcasts, magazines, and news outlets.
