
After waiting almost two years (since the filing of our Rule 32 in April 2021), our evidentiary hearing finally took place this past Thursday, February 23, 2023. Because of two special friends, I had the finances to make it to Mobile for the hearing.
I am pleased to report that the judge heard all three of our witnesses testify at the hearing. The president of the Mobile NAACP and his right hand were also in attendance, right behind me and Leonard's family. In short, my husband's attorney has until March 31 to file a brief arguing Leonard's right to a new trial based on case law where a deceased person's confession was used to grant a new trial. Assistant District Attorney Chris McDonough has until April 28 to file his own brief.
Our attorney and licensed investigator really believe in Leonard's innocence and have already made the decision that, if our new trial is not granted, we are filing with the appellate and Supreme Court in Alabama.
