-----English version below------ Proceso lento y deshonesto Primero que nada, nosotros (mi papá Belisario, mi mamá Clara, mi hermana Carolina y yo Margarita) queremos agradecerles por haber firmado esta petición. Eso nos ha animado muchísimo. Nos da mucha fuerza y motivación para seguir exigiendo la liberación de Francisco. Es difícil pedir justicia porque las propias autoridades provocan los agravios pero por lo menos hay buenas noticias. Siguen deteniendo personas en Mapastepec y al parecer están siguiendo los procedimientos como debe ser, esto sabemos al menos de un caso. El hombre que detuvieron no podía creer que no lo habían torturado, el hombre estaba muy agradecido con mi papá. Mi papá me dijo con lágrimas en los ojos “hija, no puedo creer que todo lo que hemos hecho ya haya dado resultados”. No sabemos si ellos están actuando así porque en realidad quieren cambiar, es decir, que quieran seguir los protocolos, o más bien porque hay razones políticas detrás. Así como funcionan las cosas en Chiapas, para cuidar las apariencias, es más probable que lo segundo sea lo más acertado. De todas formas, juntos hemos hecho que un cambio fuera posible. Queremos aprovechar para ponerlos al tanto de lo que pasa. Después de que la jueza en Acapetahua se declaró incompetente en el caso, éste fue enviado a los magistrados de Tapachula. Ya que no hubo suficiente motivación para retomar el caso, lo pospusieron para el día 06 de enero. Mientras esperamos recapitulamos los hechos. Recapitulando. La Fiscalía Especializada contra el Abigeato sólo existe en Chiapas. Fue una iniciativa del Gobierno de Velasco Coello. Tiene menos de un año que existe (http://noticieros.televisa.com/mexico-estados/1507/chiapas-tiene-primera-fiscalia-robo-ganado-pais/). En Mapastepec abrió una oficina de esta Fiscalía a principios de noviembre http://costasuragencia.blogspot.de/2015/11/en-marcha-fiscalia-contra-abigeato-en.html. Los jueces tuvieron una reunión también a principios de noviembre de 2015 (http://www.noticiasnet.mx/portal/chiapas/general/seguridad/262271-se-reune-escandon-cadenas-magistrados-tapachula) sobre el respeto a los derechos humanos. Francisco fue detenido arbitrariamente y violentado el 12 de noviembre. A este acto de inauguración fueron distinguidos algunas personas, no fueron invitados todos los ganaderos solo aquellos amigos de amigos, conocidos en la zona, en su mayoría miembros de la asociación ganadera local. Es decir gente del medio que pidió esta Fiscalía para que velara por los intereses de los ganaderos. Francisco estuvo ahí, cuenta mi papá que Francisco le dio la mano al Lic. Liévano Flores, el responsable de esta Fiscalía en el Estado. Cuando mi papá le contó a Francisco que visitó a este funcionario en Tuxtla Gutiérrez mi hermano expresó “ah, si, recuerdo haber saludado a ese güero en la inauguración”. Así de torcido es este caso. Francisco es inocente y no merece este trato. No nos cansamos de repetir, que no estamos en contra de la Fiscalía, sino que deben realizar bien su trabajo y sin importar a quién detengan deben respetar la dignidad humana de cualquier detenido. Se acudió a presentar una queja en la Comisión Estatal de Derechos Humanos, también en el Centro de Derechos Humanos “Fray Bartolomé de Las Casas”, en la Comisión Nacional y Estatal de Derechos Humanos, al Palacio de Justicia del Estado y otros. Mi papá estuvo visitando a fiscales y magistrados de la región Altos y centro con tal de sensibilizarlos sobre la situación que estamos pasando. La respuesta generalizada que hubo es “es un proceso penal y hay que esperar los resultados del proceso”. Hemos esperado ya 41 días hasta hoy. Podríamos pensar en que este caso es aislado, pero no es así. Las detenciones arbitrarias son muy frecuentes en nuestro país para muestra este documental: https://www.youtube.com/watch?v=sHBcF29hMyU, hay otras causas, como Acteal, contra la minería, los profesores, la guerra de baja contra los zapatistas y muchos otros en Chiapas, en México, es decir, estudiantes desaparecidos, periodistas y activistas asesinados. ¿Qué es lo que ya no queremos? Impunidad, corrupción, herencia de los puestos públicos, descaro en manejo de las finanzas públicas, desvío de recursos, mala administración, uso y abuso del poder político y judicial. En el caso de Francisco, los jueces no han podido deliberar en su caso. Por motivos de salud, porque simplemente no han podido presentarse a trabajar o porque no tienen la suficiente motivación de hacerlo. El día en que debían hacer el careo, la parte demandante y los “policías” que lo detuvieron, no se presentaron. Ni estos, ni la juez. Este proceso es deshonesto e injusto para Francisco y para esta familia. Se acercan las festividades del mes de diciembre. Todos piensan en fiestas, en reunirse con la familia, amigos, en regalos, en vacaciones. Nosotros también. Pero esta vez al parecer la pasaremos a lado de Francisco en el penal, donde injustamente se encuentra privado de su libertad pero nos sentimos tranquilos porque Francisco también lo está, él está privado de su libertad pero no de su imaginación ni de su mente. Muchas personas, amigos y familiares lo visitan cada vez que tienen oportunidad para asegurarse de que está en buenas condiciones físicas y sicológicas. Por todo esto les pedimos que sigan comentando sobre este caso, que inviten a sus amigos y familiares a conocerlo y firmar la petición, pues cada vez que firma una persona, esta toma conciencia de lo que está pasando, se indigna con nosotros, no se queda callada y además envía un mensaje al correo electrónico a cada una de las personas a quién está dirigida esta petición. Les pedimos que no se olviden de ustedes mismos, pues esto nos pasa ahora a nosotros, esto pasa en Chiapas, esto pasa en México, parece que se tratara de un caso aislado, pero no es así, se trata de todos nosotros y nuestra responsabilidad de vigilar a nuestros gobernantes para que no se enfermen de dinero y de poder. Exigir que hagan bien su trabajo en las instituciones públicas en las que desempeñan sus funciones, también esta es una oportunidad de conectarnos. Puede que a muchos de ustedes no los conozcamos pero como decimos en las manifestaciones “No te conozco pero te necesito”. All you signing has cheer us up a lot! It has giving strength and motivation to keep demanding Francisco’s freedom. It is hard to ask for justice because it was the own authorities who made the aggravations but at least there is a good news. Apparently the police have detained other people; they have made all the procedure as it´s supposed to be, at least in one case that we know. My dad told me that he talk one of these persons in jail and the man couldn´t believe that they didn´t torture him, the man was very thankful to my dad. May told me with tears in his ayes “I can´t believe that everything we that have done has brought a result”. We don´t know if they are acting like that because they actually want to chance and fallow the protocols or there are political reasons behind, knowing how the things work in Chiapas, the second option it´s more possible. Anyways, we (including you) had made this chance possible. I want to take this moment to update you in the case. After the judge in Acapetahua declared herself unfit to trial in this matter the case was sent to judges in Tapachula. There was not enough motivation to take the case in December, so the judges postpone it to January 6th, while we wait, we sum up the story. Summing Up: The Prosecution Office against Cattle Rustling exists only in the state of Chiapas. It was promoted by the Velasco Coello government. In Mapastepec an extension of the Prosecution Office was open at the beginning of November http://costasuragencia.blogspot.de/2015/11/en-marcha-fiscalia-contra-abigeato-en.html. The judges had a meeting at the begging of November 2015 regarding the respect of human rights. At the act of this opening not all the cattle ranchers were invited; only close friends and friends of them. The majority of the guests were members of the Local Association of Cattle ranchers. These people were the ones who ask to have a Prosecution Office to watch for the cattle rancher’s interest. Francisco was there. My dad told us Francisco shaked hands with Mr. Liévano Flores who is in charge of the Prosecution office at the state level. When my dad told Francisco he visited Mr. Liévano in Tuxtla Gutierrez, the state capital, my brother said: “ohh yes I remember saying hi to the güero (blond hair person) at the opening event. This is how this case is so crooked it. Francisco is innocent and he does not deserve what is happing to him. Again, we will not get tired of saying We are not against the Prosecution Office we just them to do the job right and anybody who is arrested be treated with respect and dignity. Now my brother Francisco in not only in jail but he is also trapped in legal process that will take time. My father visited different Human Rights intuitions office such as Centro de Derechos Humanos “Fray Bartolomé de Las Casas”, and Comisión Estatal de Derechos Humanos. He also visited different judges around the state to tell them about my brother’s case. In general everybody responded: “he is in a criminal process, we have to wait for the process results”. We have been waiting for 41 days already!!!! We can think this case may be a rare case, but unfortunately is not. Arresting people in an arbitrary way is an everyday event in our country Mexico. We don´t want more corruption, impunity, sick politicians of money and power, use and abuse of political and police forces. All this time the legal process for my brother has been dishonest and unfair. He is still in jail because the judges in Tapachula have not done anything about it. They have not done anything and they are having excuses such as been sick, not showing off at work, or lack of motivation. On December 8, 2015 the “police officers” who arrested my brother were going to be interviewed. They did not show up. Neither the judge in charge of the interview showed up at her office. It was such a mockery. The December holydays are here. We all are thinking about being together with our families, friends, vacations, presents, etc. We are thinking about it too. But it seems we are going to spend the holidays in jail with my brother, near of far, we will be with him. He is calmer now, because he has his conscience in peace, he is locked but his imagination and thoughts are not, many friends and family visit him every time they can, to make sure he is safe.
