---------To read in english see below------- Mapastepec, Chiapas, México. 01 de Marzo de 2016 Carta abierta de agradecimiento Familiares, amigos y todas las personas que se solidarizaron con la causa de Francisco José en Mapastepec, Chiapas, México y el mundo: Quiero manifestar que mi hijo Francisco José ya se encuentra en libertad absoluta, completamente libre de cargos ya que desde un principio esos cargos fueron falsos, aún así tuvimos que soportar el penoso e innecesario proceso legal para demostrarlo. Fueron 85 días que estuvo encerrado. Aunque el tiempo para el ser humano es relativo y estos 85 días pueden interpretarse como un corto o largo periodo, lo cierto es que este suceso quedó marcado en nuestros corazones para siempre. ¿Hubo justicia para Francisco? ¿Qué es la justicia? La idea de justicia sería ver encerrados a esos individuos que cometieron el atropello contra mi hijo. Sabemos que eso no va a suceder, tampoco compartimos el acto de la venganza. Sabemos que el sistema de justicia mexicano tiene muchas fallas. Lo que sí queremos hacer es un llamado a las autoridades, este es muy claro: no procedan arbitrariamente, ni con violencia contra nadie, no es correcta la forma en que están actuando. Los valores están en decadencia y tenemos que recuperarlos. También hago un llamado a la sociedad, en especial en Mapastepec, para que nos cuidemos unos a otros. Reflexionemos todos cómo estamos actuando. Para no verlos inmiscuidos en manos de la “policía” ni en el fallido sistema de “justicia” mexicano que desafortunadamente no garantiza un proceso digno ni transparente. Si continúan estas detenciones arbitrarias y violentas no se queden callados. Yo no soy experto pero tenía que defender a mi hijo inocente, por lo tanto, en este proceso aprendí algunas cosas. En una detención es importante que la policía se identifique, cuente con una orden de aprehensión, de lo contrario trataran de sembrarte pruebas y ellos dirán que te detuvieron en in fraganti, lo cual le paso a Francisco y tales pruebas eran falsas. Que no maltrate a las personas en su detención, es decir, no deben torturar a nadie. También hay que tener un abogado, si no pueden contratar uno particular, en el juzgado deben asignarle uno de oficio. Desde el principio, hay que conocer el expediente, este se solicita con el abogado y si éste se tarda, el propio detenido lo solicita o cede un poder para que los familiares accedan a él. En el expediente debe estar escrito de qué y quién acusa o por qué están deteniendo a la persona. Conocer el expediente es básico. Si el proceso no les parece digno ni transparente acudan a la Comisión Estatal de los Derechos Humanos en Tuxtla Gutiérrez, el Centro de Derechos Humanos “Fray Matías de Córdova” en Tapachula, el Centro de Derechos Humanos “Digna Ochoa” en Tonalá. Estas son instituciones que vigilan el respeto a los Derechos Humanos, con quienes se puedes quejar si te han violentado de algún modo, para vigilar las condiciones físicas y sicológicas de los detenidos y observar que se tenga un proceso legal digno y transparente. Son procedimientos que toman tiempo y provocan gastos, pero los abusos continúan es mejor no quedarse callados porque no debemos permitir estas aberraciones. Hay que tener perseverancia y mucha paciencia. Sobre todo conservar la calma porque entre tanta desesperación a veces no sabemos cómo actuar. Finalmente agradezco infinitamente, también en nombre de mi familia, todas las visitas, los mensajes verbales y escritos que nos hicieron llegar, a nosotros y directamente a Francisco José. Estaremos siempre agradecidos con ustedes por no dejarnos solos y saber que nos acompañaban. Reciban un saludo afectuoso directamente de Francisco José que ya pudo apreciar con detenimiento todas las muestras de solidaridad y apoyo. Vivamos en paz. Family, friends and to all the people that were in solidarity with Francisco José in Mapastepec, Chiapas, Mexico and other parts in the world. I want to tell you Francisco is finally free; he is absolutely free. Also, he is free of any charges, obviously because we was innocence since the beginning of the process. Unfortunately we had to go through this legal nightmare to prove it. Francisco was 85 days in jail. Even thought the concept of time for human beings is relative, those 85 days can be interpreted as a short or long period of time. The truth is for us that event left a scar in our hearts forever. Was there justice for Francisco? What is justice? The idea of justice could be materialized when we see the policemen who arrested and torture Francisco in jail. We know that won’t happen and we don’t want that to happen either. We know how broken the Mexican judicial system is. The only thing we can do is to send a message, a very clear one, especially to the authorities and the public staff: do not proceed arbitrarily, or with violence against arrested people or anyone. This is not the right way to do it. Values are in decay and we have to get them back. Also, I invite the people in general, but specially in Mapatepec to take care of each other. We have to watch our steps; we don’t want to see anybody else get meddle neither with the “police” nor in this cruel “justice” system. It cannot guarantee a dignified and transparent legal process. If these arbitrary and violent detentions continue you can always raise your voice. I am not an expert but I had to defend my innocent son and I have learned a few things. It is very important that the policemen identified themselves, they have to have an arrest warrant if they do not they will make up evidences and say they are arresting you in the act, which happed to Francisco; however those evidences were false. There is no reason to torture a person in the detention process, not anyone. It is important to have a lawyer, if you cannot pay for one, the Prosecution office should provide a public defender. Since the beginning it is very important to know the file, the lawyer should have access to it or the arrested person itself can ask for it. To have the file is very important to know who is accusing you and why the police have detained the person. If you noticed that the process is not transparent you can write a complaint in the National and State Human Rights Commission in Tuxtla Gutiérrez, the Human Right Center “Fray Matias de Cordova” in Tapachula or the Human right Center “Digna Ochoa” in Tonalá. These are institutions which watch the physical and psychological condition of the person under arrest and also they observe the legal process so it is transparent and fair. We know in the moment is very hard to react in the right way but all these recommendation are very important even when we are very desperate, hopeless, scare and angry. They can also cost some money and a lot of time, especially to travel and to write the complains, but it is very important to do it. You have to be perseverant and patient. Finally I want to thank you all, in the name of my family, for all the support, the visits, the messages you wrote for us and Francisco José. We will be always very thankful for your support, for not leaving us alone because you kept us company all the time, despite the distance.
