Prevent Mogoeng Mogoeng from becoming Chief Justice
The Issue
Mogoeng Mogoeng has passed a number of judgements that make it clear that he condones rape in marriage, does not understand the harm that rape causes and is not in support of women's rights to say no to sex.
His judgements in the Bophutatswana High Court indicate that is he is not familiar with the law around rape, nor does he support a woman’s right to say no to sexual advances. His judgements are not in line with the Constitution that he must defend and uphold in this position.
In addition, Mogoeng has made comments that make it clear that he is not in support of the rights of LGBTI people. He is a pastor in a church that believes that homosexuality is a perversion that must be cured. This again is not in line with the constitution of South Africa.
Furthermore, Mogoeng is inexperienced as a Constitutional Court judge and there are a number of more experienced judges, who have done a substantial amount more to protect the Constitution and the rights of women.
A number of civil society groups, political parties, trade union movements and international civil society groups (such as Nobel Women) have called for the retraction of this nomination.
Although the JSC voted in favour of his nomination, it does not have to end here. We can sign this to make a difference.
