Postpone 221 Balliol Balcony Project until October-Protect Residents During Summer Heat

The Issue

We, the undersigned residents of 221 Balliol Street, are asking Park Property Management to postpone the scheduled balcony railing replacement project until the fall, preferably October 2026.

We understand that repairs and maintenance are part of owning and operating an apartment building. Our concern is not with the project itself, but with the decision to carry it out during the hottest part of the summer and with the limited information provided to residents.

The notice dated July 20, 2026 advises that work will begin on August 4, giving residents approximately two weeks to prepare. However, it does not tell us:

  • how long the project will last;
  • when work will begin on each section of the building;
  • how long individual balconies will be inaccessible;
  • when residents will be able to use their balconies again;
  • whether window air conditioners must be removed and, if so, when they can be reinstalled; or
    what plans are in place to protect residents during periods of extreme heat.

Our building does not have central air conditioning. Many residents rely on window air conditioners as their only way to keep their apartments at a livable temperature during the summer. Removing those units in August, without providing a timeline or practical alternatives, will have a serious impact on many residents.

The notice refers residents to a respite room at 66 Isabella Street. That location is approximately 30 minutes away by public transit from 221 Balliol Street. For many residents—including seniors, families with young children, people with disabilities, and those working from home—travelling that distance simply to cool down is not a practical solution.

The notice also states that the project is intended to improve the safety, appearance and longevity of the building. Nothing in the notice suggests that this is emergency work that cannot reasonably be postponed until cooler weather.

We are not asking that the project be cancelled. We are simply asking that it be rescheduled to a cooler time of year and that residents be provided with enough information to prepare for the work.

We are therefore asking Park Property Management to:

  • postpone the project until October 2026;
  • provide residents with a construction schedule showing when each section of the building will be affected;
  • provide an estimated completion date for the project;
  • explain how long balconies will be inaccessible;
  • explain how tenants are expected to manage without air conditioning if window units must be removed; and
  • advise what measures will be taken during periods of extreme heat.

We believe these are reasonable requests. Delaying the project until the fall would greatly reduce the impact on residents while still allowing the work to be completed before winter.

Our goal is to work with Park Property Management to find a practical solution that balances the need for these repairs with the health, comfort and well-being of the residents who live here. We believe postponing the project until October is a reasonable compromise that would significantly reduce the impact on tenants while still allowing the work to proceed in a timely manner.

If the project proceeds without addressing these concerns, residents reserve all rights available to them under the Residential Tenancies Act, including the right to apply to the Landlord and Tenant Board for any remedies that may be available, including rent abatements, compensation, or any other relief the Board considers appropriate. Section  22 of the Residential Tenancies Act and Section 8(4) of Ontario regulation 516/06 General states that to be exempt from rent abatement the landlord must give 60 days notice for the work, and the notice must describe the length of time the work is expected to take. The landlord thus has a choice: either delay the work start date or the tenants will lawfully ask for a rental abatement for the duration of the construction.

We ask that Park Property Management respond to this petition before construction begins so that residents understand how these concerns will be addressed.
