Revise Pedal Assisted E-Bike Laws
The Issue
Electrically Assisted Pedal Cycles (EAPC), commonly referred to as Pedal E-Bikes, are fast becoming a popular and cost effective alternative to commuting by Bus, Car or Train.
Unfortunately, there are limitations with E-Bike laws that pose greater safety risks than intended safety benefits.
This petition aims to address three primary concerns with current EAPC Laws and propose a suitable amendment for each for each. Please see below:
Concern 1 - Maximum Wattage
Proposed Amendment - Remove/Increase Maximum Wattage Limitations.
Cyclists riding E-Bikes to get around are often trying to get fit and healthy, but many also need the added electrically assisted power to overcome physical disabilities, injuries or fitness limitations that rule out the use of traditional non-electric bikes. The current limit of 15.5mph cannot be exceeded regardless of maximum power output. Thus, an increase from the current 250W maximum power output would substantially aid riders in maintaining a steady and consistent speed. This is particularly significant for cyclist who encounter challenging terrain or steep inclines, where the current power limitations fail to sufficiently assist the rider. There are instances of riders falling off bikes, coming to an abrupt stop or weaving across the road due to insufficient electronic assist. The proposed change would greatly benefit all road users.
Concern 2 - Maximum Speed Limit
Proposed Amendment - Increase the Maximum Speed limit from 15.5mph to 20mph
The moderate increase in maximum speed limit would enable e-bike cyclists to reach and maintain a speed more closely matching that of other road vehicles in dense urban areas and residential streets. A consistent law for all modes of transport would prevent the desire for motorists to overtake slower e-bike riders and encourage bike riders to stick to the road and away from pedestrian routes.
Concern 3 - Power Throttle Ban
Proposed Amendment - Enable Throttle Assist
At present, Electrically Assisted Pedal Cyclists riders cannot utilise a throttle and must rely solely on pedal assist. Unfortunately, there is a substantial gap between initial pedalling and power initiation, which can cause rider instability from a stationary starting position. Enabling a Throttle Assist that cannot exceed the maximum EAPC speed limit only seeks to aid in moments where power delivery is crucial. Additionally, mitigating the acceleration deficit between e-bike and other road vehicles is beneficial to the safety of all road users.
Revising current restrictions is no longer a recommendation, rather a fundamental necessity. Lessening restrictions on EAPC class E-Bikes will greatly increase their inclusivity and bolster their chances of becoming a sustainable alternative to larger and more expensive modes of transportation. Crucially, these amendments will undoubtedly improve road safety for all road users.
