Petition to the Mississippi Real Estate Commission: Modernize Advertising Rules for Social

The Issue

We, the undersigned Mississippi real estate professionals, respectfully submit this petition requesting a thoughtful revision to the current advertising rules as outlined in Rule 30-1601-3.3 of the Mississippi Administrative Code.

Under this rule, all real estate advertisements must include the brokerage name and phone number. While we fully recognize and support the intent of this regulation—to ensure transparency and allow prospective clients to contact the brokerage directly—we believe there is room for flexibility when it comes to social media platforms.

Social media is no longer just a tool for personal connection; it has become an essential part of how real estate professionals market properties, educate the public, and build meaningful relationships with potential buyers and sellers. However, current platform algorithms often interpret the inclusion of phone numbers in posts as spam-like content. As a result, these posts are suppressed and shown to fewer users—greatly limiting our ability to reach our intended audience.

Mississippi agents work tirelessly to create compliant, informative, and engaging social media content. Unfortunately, this rule unintentionally hinders our visibility and growth in the digital space.

We are not asking for a change to the rule as it pertains to traditional forms of advertising. We agree that the brokerage name and contact number should be present on websites, print materials, signs, and any medium where a potential client may need immediate and direct access to the firm.

With today’s technology, it is easier than ever for a potential client to locate a brokerage’s phone number through a quick online search or by visiting the brokerage’s website or professional profile. Contact information is readily accessible across multiple platforms, making it unnecessary to include the phone number in every individual post in order to ensure consumer access.

What we are asking is simply this:

Allow licensed real estate professionals in Mississippi to omit the brokerage phone number on social media posts, while still clearly displaying the brokerage name.

This small, targeted change would help us stay competitive in today’s digital marketing environment while still upholding the transparency and accountability that MREC rightfully values.
