The Issue

We, the undersigned homeowners and residents of Brigade Gardenia, call upon the Brigade Gardenia Apartment Owners’ Association (BGAOA) to immediately suspend the recently introduced financial charges and place them before the membership for discussion and approval at the upcoming Annual General Meeting (AGM).

Over the past few weeks, Brigade Gardenia homeowners have been notified of multiple revisions involving financial charges that directly impact residents, including:

Revised Transfer Fees for resale and purchase of flats.
Revised Renovation and Interior Work Caution Deposits.
Introduction of non-refundable deductions from so-called “caution deposits.”
Additional charges for extension of renovation timelines.
These decisions have been communicated through notices issued by the Managing Committee and implemented with little or no opportunity for meaningful consultation with homeowners.

Why This Matters

Brigade Gardenia is not merely a collection of buildings. It is a community owned by its residents. The Association exists to serve the interests of homeowners and to manage common assets in a transparent and accountable manner.

While residents understand the need for regulations, safety protocols, and administrative processes, any decision that imposes new financial obligations on homeowners should be supported by transparency, consultation, and community participation.

Our Concerns

1. Financial Decisions Are Being Implemented Without Resident Consultation

The recent revisions have a direct monetary impact on homeowners. However, residents were not provided an opportunity to discuss, review, or provide feedback before implementation.

The Annual General Meeting is only weeks away. Matters affecting hundreds of homeowners financially should be discussed with the membership before being enforced.

2. A “Caution Deposit” Should Not Become a Hidden Fee

The revised renovation policy requires homeowners to pay caution deposits ranging from ₹2,500 to ₹30,000 depending on the nature of work.

However, for several categories, only a portion of the deposit is refundable. The balance is retained even when no damage is caused to common property.

A caution deposit is intended to protect against actual damage. If money is being retained irrespective of damage, residents deserve a clear explanation of the basis for these deductions and the costs they are intended to recover.

3. Lack of Transparency in Calculation of Charges

Residents have not been provided with:

The methodology used to determine these amounts.
The actual costs that these charges are intended to recover.
Any financial analysis supporting the revised structure.
The rationale behind the non-refundable component of renovation deposits.
Transparency is a fundamental principle of good community governance.

4. Penalties for Renovation Delays May Be Unfair

Renovation timelines can be impacted by labour availability, contractor schedules, material procurement delays, inspection requirements, and unforeseen technical issues.

A rigid penalty structure that does not adequately account for circumstances beyond the homeowner’s control may unfairly burden residents.

5. Homeowners Deserve a Voice

Brigade Gardenia is governed by its members. Major policy decisions involving new charges, fees, deposits, or financial obligations should be discussed openly and subjected to community scrutiny before implementation.

The AGM exists precisely for this purpose.

Our Demands

We respectfully request that BGAOA:

Immediately suspend implementation of the revised renovation deposit and charge structure.
Defer implementation of any recently introduced financial charges that have not been discussed with homeowners.
Publish the rationale, calculations, and supporting documentation used to determine these charges.
Include these matters as agenda items for discussion at the upcoming AGM.
Allow homeowners the opportunity to review, discuss, and vote on policies that directly affect them financially.
This Petition Is Not Against Regulation

We support reasonable measures to protect common property, maintain community standards, and ensure renovations are conducted responsibly.

This petition is about transparency, accountability, and the right of homeowners to participate in decisions that affect them financially.
