Petition to Require Licensing and Insurance for Home Builders and Contractors in Texas

The Issue

 

Too many have fallen victim to unlicensed businesses or people who perform under the title “Contractor.” This includes myself, a veteran who these businesses have taken advantage.   These individuals or businesses have often wronged customers causing damage to property, failed to perform job to completion as outlined in contracts or verbal agreements, or failed to even show up to agreed worksite at all; often leaving customers high and dry! 

Texas DOES NOT require Home Builders, Contractors or Fencing Companies to be licensed  

 

The current small claims court process leaves the burden of enforcement on the favored plaintiff, often requiring clients to exhaust additional funds to recover damages against these businesses.

Individuals or businesses at fault often take advantage of the system, realizing that many clients will often give up or lose hope in pursuing justice against these dishonest and corrupt entities.

Therefore, in the interest of protecting consumers and ensuring high standards of service, we, the undersigned, call upon the State of Texas to enact legislation requiring all home builders, contractors, and fencing companies to be licensed and insured. This will ensure that these businesses meet the necessary qualifications and are accountable for their work.


Additionally, we propose that any of these types of business found guilty in a civil suit related to their professional services should face strict penalties to protect consumers:


 1. License Suspension: Businesses found guilty in civil suits should have their licenses suspended by the state until full payment is made to the plaintiffs.
 2. License Revocation: If payment is not received by the plaintiff within 60 calendar days, the business’s license should be revoked for five years.
 3. Owner Ban: The owner of any business whose license is revoked should be banned from being named on any business license within the state of Texas for five years.
