The Issue
On June 1, 2014, in Williston, Florida, Dustin Heathman was setting up his speaker system when he glanced out the window and saw a police officer with a shotgun walking through the front yard. Right from the very start they were prepared to kill, all for a suspended driver's license. A SWAT team came not long after, and surrounded the house. They had the Bomb Squad, snipers, grenadiers, and a negotiations unit. They chose to send in a small army to handle what amounts to, at worst, a minor traffic violation, a charge which has since been dropped.
Following a financial argument, Dustin's father had decided to call the cops on Dustin and lied to them, claiming that Dustin had stolen from him. He also told them that there was a warrant for Dustin's arrest for the suspended license. So the Marion County Sheriff's Office (MCSO) responded by sending in a SWAT team. Dustin's father had not actually seen him or been to his home for at least one year beforehand, and had no idea what Dustin had or what he had been doing. Much of the information he gave to the police was inaccurate and based solely on assumptions. He lied about the stolen items, and Dustin was never charged with any kind of theft.
Dustin has plenty of case law to show that traveling along public roads, including via automobile, is a Right protected by the Constitution, rather than a privilege, and that licenses are only required in commerce. All laws must be in agreement with the Constitution. Unconstitutional 'laws' are null and void as if they had never been passed. In addition, American common law says that if there's no victim, there's no crime. So where's the victim? What's the crime? He felt that he had no duty to surrender, as he had broken no valid law.
Fearing for his life and knowing he hadn't actually done anything wrong, Dustin tried to avoid confrontation. These weren't regular police officers that came for him; they were paramilitary troops. Dustin has been speaking out against the police state for a long time. He knows it's not even as simple as "comply or die" anymore. There have been plenty of people who have complied with officers, and gotten shot anyway. Dustin had good reason to fear for his life.
He started talking to the SWAT negotiator over the phone. He told her that he wanted to resolve the situation peacefully. He talked about his rights, and how he knew he had broken no valid law. He was not threatening to kill cops, and he was not making 'anti-government statements.' He never said that he wanted to die. Of course, the sheriff's office told the media that he'd said these things, when in fact he said nothing of the kind.
By their own admission, the SWAT van moved forward, and Dustin believed they were going to storm the house, which would have led to a nasty situation in which a lot of people would have died, as then he'd have been defending his home. Officers opened fire on the house. They used 3 cans of tear gas. Dustin had every right to defend himself, yet he did not hurt ANYONE in doing so. He was forced to. If he hadn't handled things the way he did, he likely would have been killed. They were the aggressors. They came prepared for war, escalated things every step of the way, and they clearly had no interest in a peaceful resolution. But Dustin never tried to kill anyone. He had plenty of opportunities for hours to kill cops if that was his intention. They allege that he shot at their armored vehicle with the intent to kill officers. But that doesn't even make sense. What kind of would-be cop killer would choose a bulletproof vehicle over the officers standing out in the open? Dustin actually had the advantage that day, as he was inside where they couldn't see him, but he could see them. If he'd wanted to kill officers, he would have.
Dustin came out and surrendered, was handcuffed, and then severely beaten while he was no longer able to defend or protect himself. He suffered a fractured eye socket and a concussion, and had a small piece of his ear removed. Court documents say he was fully compliant and posed no threat to anyone. Sheriff Chris Blair was recently caught in yet another lie. He told the media that he knew nothing of Dustin's beating and that Dustin had not filed a complaint about the beating. However, Dustin has paperwork that proves Sheriff Blair knew about the beating and did nothing about it. Dustin filed complaints to the FDLE, the state attorney general's office, and the US District Court, and the sheriff was served a civil rights complaint summons by US marshals as early as last year.
Dustin is being charged with ten counts of attempted murder on law enforcement. They lied to the media about what happened. They told the media that he wanted to kill as many officers as he could before dying by suicide by cop. But this is not true at all. If he had wanted to kill cops he would have. Dustin grew up around firearms and knows how to shoot! Rule number one when trying to shoot someone: aim at them!! Dustin never even aimed a gun at any of the officers. With all the firepower they say he had, he could have dealt them some serious damage. And at that range, he would not have missed. Yet, he didn't put a scratch on anybody.
Marion County said in their report that the reason they came for him with so much force is because they didn't like what they called his "anti-government activities." And while Dustin is politically active on social media, he has never committed any kind of crime in expressing his views online. He stands for the Constitution and is a true American patriot.
Despite coming prepared for war, the police say that they did not record anything during the entire course of events. According to them, no dash cam, helmet cam, or body cam footage exists, nor are there any audio recordings of the negotiations. Meanwhile Dustin actually did record something and posted it on Facebook, while the officers were outside. He tried to show the world what they were up to, what they were planning. So, if these allegations against Dustin were true, why would he record his own crime? And why would the sheriff's office not have any cameras rolling during a tactical deployment?
Marion County is extremely corrupt. They have the highest incarceration rate in all of Florida, at 1.5 times higher than the state average. They arrest more people per capita than any other county in Florida, and also has one of the highest rates of overturned convictions in the state. They arrest people for things that other counties would merely give out tickets or notices to appear for. MCSO officers have falsified reports, omitted facts, engaged in cover-ups, and lied under oath, and not just in Dustin's case, but in other cases as well.
There is no ethical reason to prosecute Dustin. If the integrity of the investigation is called into question, then the integrity of the prosecution must also be called into question. This case needs to be dismissed. The sheriff's office has created a false record of events. They admitted to lying under oath, falsifying reports, omitting facts, and engaging in cover-ups. The sheriff has been proven to be a liar. What else are they lying about?
Dustin has done nothing wrong. He never tried to kill anyone. He is an innocent man facing ten life sentences for standing up for his rights and not hurting anyone in doing so. We got rid of our kings in 1776.
