Petition to Protect Disability Rights: Stop the Attack on Section 504

The Issue

17 state attorneys general, including South Dakota’s Marty Jackley, have filed a lawsuit that threatens Section 504 of the Rehabilitation Act—a crucial protection ensuring students with disabilities receive accommodations and equal access to education. If successful, this lawsuit could strip millions of children of essential support like assistive technology, therapy, classroom modifications, and individualized learning plans.

As a single mother of a child with autism, I know firsthand how life-changing these services can be. My son was nonverbal before receiving an IEP at age three. Because of the speech therapists, occupational therapists, paraprofessionals, and educators who have worked with him, he is now thriving—engaging with classmates, communicating more, and building confidence. Just last week, he initiated play with his classmates, something that would have been unimaginable a few years ago.

If this lawsuit succeeds, children like my son—and millions of others with disabilities, chronic illnesses, ADHD, dyslexia, mental health conditions, and more—could lose the accommodations that help them succeed. Without these protections, students may be denied extra testing time, mobility aids, behavior support plans, medical accommodations, and other vital resources that level the playing field in education.

This is an attack on disability rights, and we must take action now. We demand that Marty Jackley and other attorneys general withdraw from this harmful lawsuit and stand up for the civil rights of disabled students.
