Petition to Oppose High-Impact Drive-Thru and Nuisance Commercial Permits on Tract A (653
The Issue
TO: The Brevard County Board of County Commissioners, The Brevard County Planning and Zoning Board, and the Zoning/Code Enforcement Division.
PETITION STATEMENT:
We, the undersigned residents, homeowners, and stakeholders of the Indian River Isles subdivision and surrounding residential neighborhoods in unincorporated Rockledge/Brevard County, do hereby state our formal and unified opposition to any proposed development plans on Tract A (653 Helmsman Place, Parcel ID: 26-36-12-04-A) that include high-impact commercial operations, including but not limited to fast-food restaurants, drive-thru facilities, or 24-hour retail establishments.
While we acknowledge the parcel's baseline commercial land designation, we firmly assert that high-turnover drive-thru applications at this specific location pose a direct threat to public safety and neighborhood welfare. The intersection of US-1 and Helmsman Place is a vital residential ingress/egress point that cannot safely accommodate the concentrated, peak-hour traffic volumes generated by fast-food infrastructure. Furthermore, the immediate proximity of residential property lines means any commercial speaker boxes, idling vehicles, and late-night operational lighting will cause severe noise, air, and light pollution nuisances.
Therefore, we respectfully demand that the Brevard County Planning and Zoning Board and the Board of County Commissioners:
- Deny any requests for Conditional Use Permits (CUP), Special Exceptions, or zoning variances regarding drive-thru infrastructure or extended operating hours on this parcel.
- Enforce maximum restrictive buffering, including mandatory 8-foot masonry privacy walls and dense, multi-layered landscaping screens, should any low-impact commercial project move forward.
- Mandate a comprehensive, independent Traffic Impact Analysis factoring in the immediate residential queueing needs on Helmsman Place before any site plans are approved.
