I am writing to formally request that Congress take action to ban Homeowners Associations (HOAs) nationwide on the grounds that they violate constitutional rights and infringe upon individual property ownership.
HOAs function as quasi-governments, imposing fines, liens, and restrictions on homeowners without due process or proper constitutional oversight. They limit freedoms protected by the First, Fifth, and Fourteenth Amendments, including:
Freedom of Speech and Expression – Many HOAs prohibit political signs, religious displays, and personal property choices, directly infringing on First Amendment rights.
Unlawful Taking of Property – HOAs have the power to foreclose on homes and levy excessive fines, often without judicial review, violating the Fifth Amendment’s protection against unlawful deprivation of property.
Lack of Due Process and Equal Protection – Unelected boards operate without proper accountability, creating inconsistent enforcement of rules that often favor select homeowners over others, contradicting the Fourteenth Amendment.
HOAs also impose burdensome fees and restrictive covenants that force homeowners to abide by private contracts they may not have knowingly or willingly agreed to, leading to financial and legal hardship. The very notion that a private entity can dictate how a homeowner utilizes their own property is a violation of property rights at the core of American liberty.
I urge you to introduce or support legislation that would abolish HOAs and return full property rights to homeowners. It is time to restore the constitutional freedoms of property owners and end the unchecked power of these unaccountable associations.
