PETITION TO AMEND THE CONSTITUTION FOR TRANSPARENT AND VERIFIABLE ELECTIONS

PETITION TO AMEND THE CONSTITUTION FOR TRANSPARENT AND VERIFIABLE ELECTIONS
The Issue
PETITION SUMMARY
The undersigned concerned citizens of South Africa believe that the word "fair" with reference to elections, is subjective and leaves opportunity for misinterpretations in the constitution. Therefore, we hereby petition the Joint Constitutional Review Committee to amend the Constitution of the Republic of South Africa to strengthen the electoral integrity for transparency and verifiability by replacing the word "fair" with "transparent, verifiable" in the two key sections related to elections.
PROPOSED AMENDMENTS
- Chapter 2: Bill of Rights, Section 19(2)
Current text: "Every citizen has the right to free, fair and regular elections for any legislative body established in terms of the Constitution."
Proposed text: "Every citizen has the right to free, transparent, verifiable and regular elections for any legislative body established in terms of the Constitution." - Chapter 9: State Institutions supporting Constitutional Democracy, Section 190(1)(b)
Current text: "The Electoral Commission must ensure that those elections are free and fair;"
Proposed text: "The Electoral Commission must ensure that those elections are free, transparent and verifiable;"
RATIONALE
While the current Constitution provides for "free and fair" elections, these terms are subjective and open to interpretation. In the modern democratic context, especially with evolving technology and global best practices, there is a critical need for explicit constitutional provisions that mandate not just fairness, but transparency and verifiability in the electoral process.
Why this amendment is necessary:
- Constitutional clarity: By explicitly including the requirements of transparency and verifiability in the Constitution, we establish unambiguous standards for our electoral processes.
- Public confidence: Transparent and verifiable elections enhance public trust in democratic institutions and electoral outcomes.
- Electoral integrity: The amendments would strengthen South Africa's electoral integrity by establishing constitutional requirements for processes that can be independently verified.
- International standards: The proposed language aligns with emerging global standards for electoral best practices.
- Future-proofing: As electoral technologies evolve, constitutional requirements for transparency and verifiability will ensure that new systems must meet these standards.
IMPLEMENTATION IMPACT
This amendment would require the Electoral Commission to implement systems and procedures that are not only fair but demonstrably transparent and independently verifiable. This may include:
- Transparent ballot handling procedures
- Verifiable counting methods
- Accessible and auditable election records
- Clear verification mechanisms for all stages of the electoral process
CONCLUSION
We believe these constitutional amendments are necessary, timely, and in the public interest. They maintain the core principles of free elections while strengthening the integrity of our democracy through explicit requirements for transparency and verifiability.
SIGNATURES DISCLAIMER
By signing the petition, I support the proposed constitutional amendments to replace "fair" with "transparent, verifiable" in the specified sections of the Constitution relating to elections.
