Dear HOA Board Members,

We, the undersigned homeowners of Calnshire Estates, respectfully submit this petition requesting a modification to the current by-laws to permit the installation and use of removable above-ground pools within our community.

We understand the importance of maintaining the aesthetic and safety standards of our neighborhood; however, we believe that a properly regulated allowance for removable above-ground pools can enhance the quality of life for our residents while maintaining the community’s overall appearance and standards.

Specifically, we request the by-laws be amended to:

Permit the installation of above-ground pools that are fully removable and not permanently affixed to any structure.

Establish guidelines for the appropriate placement, maintenance, and seasonal use of these pools to ensure they do not disrupt the aesthetic value of the community.

To maintain the aesthetic integrity of the HOA community while accommodating removable pools, the following guidelines are recommended:

1. Placement

Location: The proposed location should be in the backyard.​

Setback Requirements: Pools should adhere to property line setback requirements as specified by the Township and/or HOA, ensuring sufficient distance from neighboring properties to reduce potential disputes.​

 

2. Size and Design

Pool Dimensions: The size of removable pools should be proportionate to the yard space, ensuring they do not dominate the outdoor area or infringe upon neighboring views.​

Aesthetic Consistency: Pools should be of neutral colors and designs that harmonize with the community's architectural standards. Bright or neon-colored pools that draw undue attention are allowed but discouraged.​

 

3. Safety Measures

Ladders: In compliance with safety regulations, pool ladders must be removed when not in use. 

Supervision: Young children should be supervised by an adult when using the pool to ensure safety. ​

 

4. Maintenance

Water Quality: Regular maintenance of water quality is essential to prevent algae growth and ensure the pool remains visually appealing and hygienic. ​

Equipment Storage: Pool accessories, such as toys and cleaning tools, should be stored out of sight when not in use to maintain a tidy appearance.​

 

5. Seasonal Use and Storage

Operational Period: Removable pools are permitted for use between Memorial Day and Labor Day. ​ (erecting one week before Memorial Day & disassembling one week after Labor Day)

Off-Season Storage: Pools must be fully drained, disassembled, and stored out of public view during the off-season to prevent unsightly appearances and potential damage from weather conditions.​

 

6. Compliance and Enforcement

Penalties: Non-compliance may result in penalties, including fines or mandatory removal of the pool at the homeowner's expense.​

 

We believe that implementing these measures will allow for safe, enjoyable use of above-ground pools while respecting the community’s standards. Enclosed with this petition are signatures of homeowners who support this request.
