We ask that the West Virginia Department of Environmental Protection (WV DEP) stop issuing permits for the Underground injection control (UIC) well operated by Danny Webb Construction (DWC) in Lochgelly, West Virginia. The lack of regulatory oversight and enforcement at this site resulted in stream pollution as well as soil contamination on the site and adjacent properties according to the affidavit presented by Dr. Avner Vengosh of Duke University and third party sampling conducted by local property owners and organizations. 

Danny Webb Construction has violated and WV DEP has failed to enforce several state laws as well as federal law. However, the company has not received a single citation or notice of violations for practices including mismanagement of on-site storage pits and failure to conduct water sampling or test for specified parameters- as required by a 2008 order of compliance issued by WV DEP.

The WV DEP is considering permitting this operation for another five years. As residents and concerned parties, we are asking that action be taken to prevent the issuance of any new permits for the UIC well operated by DWC in Lochgelly WV. In addition we are asking that measures be taken to assess damages done to the soils and waters of the state and property owners.

More specifically, We ask that a complete soil sampling survey be conducted on the property of DWC, surrounding properties and the entrire stretch of Wolf Creek.  In addition to the monitoring wells located on Wolf Creek, we want monitoring wells installed on Danny Webb Constructions’ property with routine testing for all parameters. These parameters must include those tested by Dr. Vengosh.

In addition; we are requesting that it be demonstrated with sufficient data that the Weir Sandstone is in fact isolated from all surface waters and drinking source waters.  If waters are being polluted, there is a violation of property owner’s Riparian Rights, and damage done to the West Virginia investment in ownership of aquatic life.

As residents and concerned parties, we are asking that action be taken to prevent the issuing of any new permits for the underground injection control well in Lochgelly, WV.  In addition, we are asking that measures be taken to assess damages done to the soils and waters of the state and property owners.  In the case that contaminants are present, we are demanding a complete remediation of any and all impairments and compensation for private property owners affected by the site.

The residents of this area are not benefiting economically from this process in any way.  Danny Webb Construction employs a handful of workers, whose work conditions are very poor and risky (see video above).

Our message is clear. We want the permitting of the Underground Injection Control Well in Lochgelly to end, and we have several reasons (West Virginia and federal legislation not enforced by the WV DEP) to ask for the removal of the West Virginia Department of Environmental Protection’s authority to oversee permitting and remediation of this site.
