The Issue
Subject: Recognizing Animals as Sentient Beings and Strengthening Penalties for Animal Cruelty
Dear Members of the Georgia Legislature,
We, the undersigned, respectfully urge you to take immediate action to strengthen the animal welfare laws in Georgia. The current legal framework, which treats animals as mere property, fails to provide adequate protection for these sentient beings capable of experiencing pain, fear, and love.
Current Legal Shortcomings:
Under Georgia law, animal cruelty is defined as causing death or unjustifiable physical pain or suffering to any animal, including through willful neglect. This is currently classified as a misdemeanor, with a fine of up to $1,000 and/or imprisonment for up to one year. A second conviction carries a fine of up to $5,000 and imprisonment for up to one year. However, a second or subsequent conviction resulting in the death of an animal is still treated as a misdemeanor of a "high and aggravated nature," with imprisonment for a minimum of three months and a fine of up to $10,000.
Aggravated animal cruelty, defined as knowingly and maliciously causing death or severe physical harm to an animal, carries a more serious penalty of imprisonment for a minimum of one year, up to a maximum of five years, and/or a fine of up to $15,000. While these penalties may seem significant, they do not adequately reflect the gravity of the offense, especially when compared to penalties for crimes against inanimate property.
In Georgia, a person who steals a television, an inanimate object, can face a felony charge with a penalty of up to 10 years in prison. In contrast, someone who maliciously kills a dog may only face up to five years in prison. This disparity is rooted in the outdated legal notion that animals are merely property, no different from a dining room chair or a television. This perspective fails to recognize the intrinsic value of animals as living beings deserving of compassion and respect.
Proposed Changes:
We propose that Georgia's laws be updated to reflect the following:
Recognize Animals as Sentient Beings: Change the legal classification of animals from property to sentient beings. This change acknowledges that animals are capable of feeling pain, fear, and affection and deserve legal protections beyond those afforded to mere objects.
Increase Penalties for Animal Cruelty: Strengthen the penalties for both animal cruelty and aggravated animal cruelty. Make the punishment for these crimes more severe, including higher fines and longer prison sentences. If a convicted individual cannot pay the imposed fine, additional jail time should be added to their sentence.
Establish an Animal Cruelty Registry: Create a statewide registry for individuals convicted of animal cruelty. This registry should be distributed to all shelters, rescues, and animal adoption agencies to ensure that those who have harmed animals in the past are prohibited from owning pets in the future.
Ban Continuous Chaining and Excessive Breeding: Include specific provisions to address the cruel practice of chaining dogs 24/7, which often leads to physical and psychological harm. Measures should also be taken to regulate and limit the excessive breeding of dogs for financial gain, which frequently results in poor living conditions and neglect.
The Urgency for Change:
According to the ASPCA, nearly one million animals are abused or killed due to domestic violence every year in the United States. These statistics highlight the urgent need for stronger legal protections for animals. Georgia should not be complacent in its current approach, which lags behind other states that have recognized the importance of treating animals with dignity and respect.
