Statement of Petition and Intent to Withdraw
San Joaquin Valley College – Electrical Technology and HVAC-R Programs

We, the undersigned students of San Joaquin Valley College, enrolled in the Electrical Technology and HVAC-R programs, respectfully submit this formal petition and notice of intent to withdraw from our respective programs on the grounds of a material and unilateral change to the terms under which we enrolled.
I. Statement of Facts
Upon enrollment, each student entered into a binding agreement with the institution, commonly referred to as the Student Enrollment Agreement. This document, which governs the financial and academic terms of enrollment, clearly stated on page two:
“New students have the right to cancel the enrollment agreement and obtain a refund of charges paid any time prior to midnight on the seventh calendar day (excluding institutionally recognized holidays) after the start of their first scheduled class session.”
For the current cohort, this cancellation period ended on April 28, 2025.
On April 29, 2025, one day after the expiration of our right to cancel without financial obligation, a mandatory meeting was held wherein students were informed that the original full-time, in-person format for which we enrolled would be converted to a hybrid model, combining online instruction from home with limited in-person classroom attendance.
This adjustment to the delivery method was not disclosed, advertised, or offered as an option prior to enrollment and materially alters the nature of the program. SJVC’s own website offers hybrid or fully online programs at a reduced tuition rate, yet we are being held to the original calculated tuition amount of $26,444 for in-person instruction.
II. Breach of Agreement
This sudden and substantial change—announced only after the window to cancel without penalty had closed—represents an act of bad faith of terms under which students agreed to enroll. It is our position that the institution has violated the principles of transparency, informed consent, and fair dealing.
Concerns arise around whether this hybrid model will degrade our quality of instruction that may translate into students’ personal safety in the future, the integrity of the agreement and the fundamental shift in terms that occurred after the ability to cancel without penalty had expired brings into question SJVC's credibility.
III. Intent to Withdraw
In accordance with page three of the Student Enrollment Agreement, which states that a student may withdraw at any time and may be entitled to a refund if less than sixty percent of the program has been completed, we hereby assert our right to withdraw from the program effective Monday, May 5, 2025.
This withdrawal is made in protest of the change to program structure and delivery, and in defense of our financial and educational interests.
IV. Petition for Redress
By signing this document, we are formally expressing our unified position:
We do not accept the conversion of our program to a hybrid format
We demand reinstatement of the originally agreed-upon, full-time in-person program
If the program is not restored to its original form, we withdraw without accepting financial liability beyond the time attended, as permitted by contract.
We know we are paying a premium with SJVC because of its reputation for in-person education which sets it apart from competing colleges, trade schools with their hybrid programs. The value of this premium and SJVC’s reputation will suffer if SJVC follows through with this hybrid model.
We respectfully request that SJVC corporate leadership review this matter and act in good faith to resolve the breach by restoring the in-person format promised to us.
