Petition of Concern Regarding the Opening of Restaurant at 621 Summit Street

The Issue

We, the undersigned residents and property owners of Summit Street and the surrounding neighborhood, respectfully submit this petition to express serious concerns regarding the operation of a restaurant at 621 Summit Street, King of Prussia, PA 19406. While we support responsible and compliant business development within Upper Merion Township, the conditions at this location raise major issues of public safety, parking inadequacy, access hazards, and incompatibility with the residential character of the area.

1. Insufficient Parking and Unsafe Access

- The existing parking lot is undersized for the anticipated customer volume associated with restaurant operations.
- The driveway opening is extremely narrow, creating a hazardous situation for vehicles attempting to enter or exit. Customers pulling into the lot risk colliding with neighboring vehicles due to the limited clearance when residents are home.
- The lack of sufficient parking will inevitably lead to street parking congestion, obstructing Summit Street and potentially limiting access for emergency vehicles and residents.
- The site layout offers no safe turnaround area, forcing cars to back into the street and increasing the likelihood of accidents.

 

2. Negative Impacts on the Residential Character of Summit Street

- The addition of a restaurant will change the quiet, residential nature of Summit Street by introducing constant traffic, delivery trucks and vehicles, and late-night activity.
- Residents anticipate persistent food odors, litter, and noise, which are incompatible with the surrounding residential environment.

- The owner has been caught multiple times on camera dumping behind the building in the woods.
- These conditions will diminish property values, reduce quality of life, and undermine the long-standing residential appeal of this area.

 

3. Pattern of Problems and Noncompliance by the Property Owner

- The property owner has already caused numerous issues for neighbors, including multiple property disputes, threats, unlawful intimidation, disregard of safety, late night noise and many other problems.
- Given this history, we request enhanced oversight from the Township’s Code Enforcement and Zoning Departments to ensure all building, occupancy, and land use approvals comply fully with township ordinances and safety standards.

 

4. Requested Township Actions

We respectfully request that Upper Merion Township:


1. Delay the issuance of any occupancy, business, or food establishment license for 621 Summit Street until the parking, traffic, and safety conditions are reviewed and verified for compliance and the well being of the current residents.


2. Conduct a site safety and traffic circulation study to determine if the driveway opening and parking meet current township requirements.


3. Require the property owner to submit a revised parking and access plan for formal review by the Planning Commission or Zoning Hearing Board.


4. Provide written clarification to nearby residents on how the commercial use was approved, including applicable zoning district rules, variances granted (if any), and ongoing monitoring to prevent nuisance conditions.
