Petition for the Right to Play Music and Conduct Resident-Led Activities in Common Areas

The Issue

BACKGROUND

As residents of The Landmark Apartments, we have always cherished our community and the beautiful common areas designed for us to enjoy. However, it became clear over time that the management team was not actively organizing events or activities to bring us together. Without these communal gatherings, the sense of unity that once defined our neighborhood began to fade. Determined to revive our community spirit, we decided to take matters into our own hands.

We started by hosting neighbor-held dinners in the commun areas. Each resident brought a dish, turning these dinners into wonderful potlucks that highlighted the rich diversity of our community. The aroma of various cuisines mingled in the air, and laughter resonated as we shared meals and stories. These dinners quickly became a cherished tradition, allowing us to bond and strengthen our connections.

Music played a crucial role in enhancing the atmosphere of these gatherings. We took turns bringing our own music systems, always ensuring the volume was kept at a level respectful of local noise regulations. Our playlists included a mix of genres to cater to everyone's tastes, and the joy of dancing and singing together brought us even closer. We decided to bring the music to the pool side in order to enjoy the sun once it came finally and we wanted to continue the neighborly events such as this duriong the incoming summer. We were always mindful of the quiet hours, making sure the music was off at the designated times to maintain peace and harmony in our community.

Despite our efforts to create a lively and inclusive environment, we faced resistance from management. Notices were posted reminding us that only management-organized events were allowed, and that "music isn't permitted, please use headphones." These restrictions felt unfair and contrary to our lease agreement, which did not explicitly forbid resident-led activities or the reasonable use of our common areas.

Understanding our rights, we came together to petition for the freedom to hold our own events and play music within reasonable guidelines. We emphasized our compliance with noise regulations and our respect for quiet hours, demonstrating our commitment to maintaining a peaceful and respectful community. We believe that prohibiting our self-organized events breaches our lease agreement, which promises the enjoyment of amenities. We, the undersigned residents of The Landmark at 11750 Wilshire Blvd Los Angeles CA 90025, are writing to respectfully request the allowance of playing music and conducting resident-led activities in our community’s common areas. We believe that such activities foster a sense of community, enhance the quality of life, and promote social interaction among neighbors.

 


Reasons for the Petition:


1. Community Building: Music and activities such as yoga, book clubs, and arts and crafts sessions provide opportunities for residents to bond and build stronger relationships.

   

2. Enhancement of Well-being: Engaging in group activities and enjoying music in communal spaces can improve mental and physical health, reducing stress and promoting overall well-being.


3. Utilization of Common Areas: Our common areas are designed to be enjoyed by all residents. Allowing music and organized activities maximizes the use of these spaces and ensures they serve their intended purpose.


4. Cultural Enrichment: Music and diverse activities can bring cultural enrichment to our community, fostering an environment of learning and appreciation for different traditions and interests.

 

 

Current Lease Agreement:


We have reviewed our current lease agreement and noted that there is no clause explicitly prohibiting the following:


"As a reminder, unless organized by the Office Management Team, please keep the party and the alcohol at home. No hired music DJ's will be permitted in the amenity areas at any time."

"Music isn't permitted, please use headphones."
Given the absence of such prohibitions, we believe that our request for music and resident-led activities is reasonable and within the bounds of our lease agreement.


Going against our current right to use the amenities within our capacity is a breach of the lease agreement between the DOUGLAS EMMET and us the current residents. No constraints outside of the current lease agreement will be respected until a due term is established through a transparent and mutually agreed-upon process.

 

Proposed Guidelines:


To ensure these activities are enjoyed by all without causing disturbances, we propose the following guidelines:


1. Volume Control: Music should be played at a reasonable volume that is considerate of all residents. After complaints from neighbors or community, sound levels will be adjusted.

   

2. Designated Times: 8:00am-10:00pm Establish specific hours during which music and activities are permitted, ensuring quiet times are respected.


3. Activity Scheduling: Residents interested in leading activities should schedule them in advance through a community calendar, allowing for coordination and avoiding conflicts.


4. Inclusive Participation: All activities should be open to all residents, promoting inclusivity and community spirit.
