Petition for the Commutation of Deano Spurlock’s Sentence

The Issue

We, the undersigned, are petitioning for the commutation of Deano Spurlock’s sentence, based on his exemplary conduct during incarceration and the unfair application of an outdated law regarding gun enhancements.

Deano Spurlock pled guilty to murder and was sentenced to two consecutive 20-year-to-life sentences, with the possibility of parole.  He was paroled from the first sentence in 2017 after serving 20 years and is currently serving the second consecutive 20-year-to-life sentence. However, his sentence was based on a law that has since been changed.

Eighteen years ago, in 2007, Nevada changed its gun enhancement law to remove the possibility of a life sentence for the use of a deadly weapon. This change in the law, however, was not made retroactive to individuals who were sentenced before 2007, including Mr. Spurlock.  As a result, Deano Spurlock remains incarcerated under a law that no longer applies to individuals sentenced after this change.

Both before and since his parole, Deano Spurlock has shown exemplary behavior and has worked hard to better himself. He has taken responsibility for his past actions and has made significant contributions to the prison community through education and rehabilitation programs. His positive conduct has earned him the opportunity for reconsideration, and many believe he has been rehabilitated and deserves the chance for release.

The original application of the law in his case now represents an outdated and unjust sentence. Nevada’s legislature made the change to the law in 2007 to provide fairer outcomes for those convicted of gun-related offenses. However, by not making the law retroactive, individuals like Mr. Spurlock continue to be sentenced under an unfair, now obsolete law.

It is clear that Mr. Spurlock’s continued imprisonment under this outdated statute is not in line with the spirit of the law or with the principles of justice. By granting a commutation, the Nevada Pardons Board would not only right a historical wrong, but also provide Mr. Spurlock with the opportunity to continue his productive life outside of prison. Additionally, we believe that Deano Spurlock is a rehabilitated individual who deserves a second chance. His release could allow him to make meaningful contributions to society and his community.
