The Issue
In 2022, the City of Allen adopted Ordinance No. 3920-6-22. Within this ordinance is Sec. 10-63(c). This section makes the possession of everyday legal items, such as metal water bottles, ice in drinking bottles, passive self-defense equipment such as body armor, nearly all weapons and self-defense tools, face coverings/masks, and many other things, ILLEGAL while engaged in any public assembly, ranging from protests to prayer vigils. This is an obvious infringement of citizens’ First and Second Amendment rights. The argument is simple: the possession of a regularly legal item CANNOT become illegal when combined with the exercise of one’s rights. Two rights do not make a wrong.
