PETITION FOR PROCEDURAL SAFEGUARDS TO ENSURE
MEANINGFUL APPELLATE REVIEW IN NYC HOUSING COURT
STATEMENT OF CONCERN
We, the undersigned, respectfully submit this petition to raise awareness of a systemic procedural issue in New York City Housing Court that affects tenants’ access to meaningful appellate review.
In Housing Court proceedings, dispositive applications—such as Orders to Show Cause, including those based on newly discovered evidence—are at times denied without written findings of fact, conclusions of law, or a preserved record. In some instances, litigants are not afforded an opportunity to be heard on the record, and no transcript or explanation accompanies the denial.
When decisions are issued in this manner, litigants are nevertheless directed to appeal. However, the absence of findings or a preserved record leaves appellate courts with nothing substantive to review. As a result, appellate review may be rendered ineffective—not because of the merits of the case, but because no reviewable determination exists.
IMPACT ON TENANTS AND ACCESS TO JUSTICE
This procedural gap disproportionately affects self-represented tenants, many of whom face the loss of their homes. Housing Court is often the first and only judicial forum available to tenants seeking relief. Appellate review serves as a critical safeguard against error, arbitrariness, and misunderstanding of the law.
Without a reviewable record, the appellate process cannot function as intended, undermining confidence in the judicial system and leaving litigants without an effective remedy.
NATURE OF THE ISSUE
This petition does not challenge the substantive outcomes of Housing Court cases, nor does it attribute intent, misconduct, or bad faith to individual judges or court personnel.
The concern raised is systemic and procedural in nature. It relates solely to the absence of minimal safeguards necessary to permit meaningful appellate review.
REQUESTED POLICY REFORMS
We respectfully request consideration of the following procedural safeguards:
Require that denials of dispositive motions include written findings sufficient to permit appellate review;
Ensure litigants are afforded an opportunity to be heard on the record when such motions are decided;
Preserve a minimal record or transcript adequate for appellate consideration; and
Provide clear guidance to self-represented litigants regarding how decisions are made and how records are preserved.
PURPOSE OF THIS PETITION
This petition is submitted in the interest of procedural fairness, transparency, and access to justice. Ensuring the availability of a reviewable record strengthens confidence in the courts and preserves the integrity of the appellate process.
