Subject: Petition for Attorney General Investigation into Deceptive Trade Practices in Lago Vista

Dear Attorney General Ken Paxton or To Whom It May Concern,

We are writing as a concerned group of residents of Lago Vista, Texas, to respectfully request an investigation into what appears to be a troubling pattern of misrepresentation and potential mismanagement involving the City of Lago Vista and one or more developers and/or homeowners associations (HOAs).

Specifically, there is strong concern among residents that the City, in collaboration with private developers, has structured agreements that result in a small, uninformed group of homeowners being bound into what effectively amounts to double taxation. Homeowners are being required, through their HOA assessments, to bear the full operational, maintenance, insurance, and staffing costs of parks and amenities that are openly designated and used as public assets under the City’s jurisdiction.

This situation raises a number of serious questions:

  • Are private HOA funds being used to subsidize public resources?
  • Were homeowners properly informed that they would be paying perpetual costs for amenities accessible to the general public?
  • Is the City effectively offloading public obligations onto private citizens under misleading pretenses?

It appears that the neighborhoods involved are being marketed or presented as private, master-planned communities, when in reality, the amenities are public and accessible to all, without contribution from the broader tax base. This inconsistency has created both financial and legal confusion for residents who now feel unfairly burdened and misled.

We respectfully request that the Attorney General’s Office investigate the following:

  1. Whether the agreements between the City of Lago Vista, developers, and HOAs were disclosed and formed in good faith and in compliance with state law;
  2. Whether the ongoing financial obligations imposed on homeowners for public assets constitute an unfair or deceptive practice;
  3. Whether there is evidence of collusion or misrepresentation by any involved parties that may have violated consumer protection or municipal governance laws.

The implications of such a scheme, if substantiated, could have significant consequences not only for our community but for similar arrangements across the state. We believe your office is uniquely positioned to ensure that public trust and legal transparency are upheld in matters involving municipal governance and HOA relationships.

Thank you for reaching out, and thank you to the citizens who have taken the time to share their concerns through the petition regarding Tessera’s parkland and HOA maintenance arrangements. I want you to know that I take this issue seriously, and I will be attending the community event in Tessera this Saturday to listen directly to residents and discuss potential solutions. If I were in your shoes—buying a home without fully being told the obligations tied to HOA-maintained public amenities—I would be upset too. Transparency matters, and I agree that we need to work toward a fix that is fair, responsible, and respectful of what residents were led to believe when they purchased their homes. This is an important conversation for Lago Vista, and I’m grateful to see the community so engaged. I’m committed to listening and working collaboratively to find a way forward.
