Fellow Residents, Here is the latest. As I mentioned in the last update, the legal counsel for the HOA sent us a letter stating that our Petition was legally deficient, specifically that we had not complied with the procedures set forth in the Bylaws to trigger the calling of a Special Meeting of the Members. Additionally, it stated that we failed to comply with the requirements for recalling a Board Member via a special meeting, as set forth in Chapter 720. We understood this to imply that they somehow disallowed more than 45 of the 245 signatures on our petition. This is an attempt to disenfranchise all the now 270+ signatures on our petition. We have gone back thru to validate our signatures. We did have 30 signatures that were home owner duplicates (both wife and husband had signed the petition). We have also validated most of the signatures. However, we do have a large number of signatures we are having trouble validating as Eastpointe home owners because we don’t have access to the HOA home owner directory. Also, the HOA has announced a HOA Board Meeting for this Friday afternoon, at 2:30 in the Men’s Card room of the Club where they intend to vote on and pass the Bi Party agreement. PLEASE SHOW UP and voice your displeasure.

The residents of Eastpointe have formed an ad-hoc committee, currently consisting of over 250 home owners and over 500+ residents, seeking the redress of grievances with the HOA. Our committee rapidly formed, engaged the residents of Eastpointe, and generated the largest turnout at the most recent EHOA Board meeting in many years. We are seeking Eastpointe Resident support for a petition, currently signed by hundreds of residents, who demand more transparency from their HOA Board, and a rebuke of the HOA President.
Our committee believes there is a fundamental connection between the role of transparency and the vitality of communities. The erosion of the democratic process has often been associated with a lack of transparency, accountability, and the suppression of information. When the suppression of information occurs, we often find instances of secrecy and deceit occurring, undermining the trust of a community. Our residents have little access to information concerning the governance of the Eastpointe community. Often our elected representatives provide no access to information on actions contemplated that will have significant impacts to the quality of life and life experience within the community.
When issues are openly and honestly discussed the importance of access to information becomes critical, and the public’s ability to hold their leaders to account. By shedding light on these issues, transparency becomes an instrument of empowerment, enabling residents to exercise their democratic rights and fulfill their civic duties. It allows the community as a whole to challenge authoritarian tendencies, combat misinformation, and preserve the democratic values that underpin a free and just community.
The residents are demanding a change to the HOA Governing Documents which eliminate any ambiguity that the initiation of any special assessments, modification of any Governing documents, and/or modification of any Bi-Party Agreements that runs as a covenant with the association’s properties, must be submitted to be approved by a majority of the voting membership present at a special or annual meeting. The Homeowners should be properly noticed and have the opportunity to read the amendments, understand them, openly discuss them and then vote on them. When non-transparent actions take place concerned residents have the legal right to take immediate action to petition the HOA Board to address a grievance and vote on particular ballot measures
