Fellow Residents, Here is the latest update on our petition submitted to the HOA Board on 20 February. We now have over 260+ signatures of our petition. I have heard from many of you about when the HOA Board is going to respond to the three points in our position.  Regarding:

 

  1. …”any actions to finalize the Bi-Party Agreement with the ECC, and any formal signing of the modified Bi-Party Agreement, until a community vote is conducted by a majority of the voting membership present at a special meeting, on the proposed final agreement.” We ask for the HOA board to replace the current negotiators with the ECC with HOA Director Jim McCrudden, RSM Dave Asciutto, and RSM Allan Marconi representing the HOA. The HOA VP Jim McCrudden has stepped up to take over negotiations with the ECC. He has removed all previous negotiators on both the ECC side and HOA side and has brought on Dave Ascuitto to participate in negotiations with the ECC. Jim McCrudden has met with Dave and Al Marconi and Kyle Hollifield met with me, to discuss previous efforts at meeting with the ECC, those results, and RSM positions on various points. Jim has stated that he is putting a counter proposal together to take to the ECC and will try to get the most fair deal possible. Several of us have been contacted from many of you over the last week…and we have heard you! Jim relays that he has heard you too. The timeline for the counteroffer should be sometime next week. We should all give Jim and Dave a chance to work this out.
  2. We received a letter today from the HOA attorney today that basically stated that our petition was legally deficient and that our petition would not trigger  calling a special members meeting. Additionally, the letter stated we failed to comply with the requirements for recalling a member of the Board via a special members meeting.  
  3. So The HOA Board and the HOA President is thumbing their nose at the 260+ residents who have asked for these actions. 
     
  4.  We are meeting with a law firm today to discuss legal strategy as required. The HOA Board and President has chosen to fight the residents instead of represent them. More to come.
