All, Tomorrow the HOA will hold a Board meeting at 2:30 at the Men's card room at the ECC. They will vote to approve the latest version of the modified Bi-Party agreement. This version of the agreement is significantly different than the version that the HOA Board tried to pass in Feb. Although it significantly changes the annual fees and includes changes that impact the relationship of every resident in Eastpointe, It is much fairer to RSMs. If we were allowed to vote on it, I would vote to approve it.
However, as we requested in our petition, you will not be allowed to vote on it because it will be passed with a Board only vote. Here are the key components of this agreement , and the changes we have been able to make to it:
Key Changes :
1. RSM 1's would pay (yr1-3) $400/$400/$400. The original request was $1200 increase the first year. We were able to reduced the total amount of dues over the three-year period and instead of the total amount occurring in first year, it is now phased in over 3 years.
2. After the 3-year period, annual increases (ECC wanted - would be based on the annual increases established by the ECC Board of Governors for golf members), we forced a change “dues shall increase annually after the initial 3 year period based on either the annual HOA fee increase or 4%, whichever is lower.” We do not believe the ECC, with outside residents, should be allowed to determine annual increases on residents.
3. 10% of Resident Social Dues will be put into a Capital fund for the use in Non Golf Amenities beginning year 1. (ECC wanted a separate 10% fee put into Club Capital fund – to be used for any purpose.)
4. RSM II New member category –
- RSM 2's Start at $7,000 annual dues and would then increase 5% or the % increase of the HOA whichever was MORE. (we wanted same annual increase as RSM 1)
- ECC wanted a $600 yr 1 & $600 yr 2 increases in dues. We eliminated this.
- RSM 2's 10% of the dues would be allocated to a capital fund to be used for NON GOLF USE ONLY.
- ½ vote on non-golf issues
- 1/2 share assessable for non-golf capital projects.
- Any member before the 15 April "Effective Date" who downgrades, can downgrade to RSM I.
6. Golf privileges for RSM 1 & 2 remain the same
7. $10K initiation fee on new home sales. We wanted $5K for condos. Not included
The current process used to develop and approve this agreement was seriously flawed. We need to make sure that this never happens again. If the residents of the community were allowed to approve the final agreement, as they should have, this agreement would look a lot different. The only way to ensure the residents have a voice in the future is to change our Governing Documents. We are almost ready to resubmit our petition to force a special members meeting that will allow residents to vote on several changes to our Governing Documents that will eliminate any ambiguity that the initiation of any special assessments, modification of any Governing documents, and modification of any Bi-Party Agreements that runs as a covenant with the Associations properties, must be submitted to be approved by a majority of the voting membership present at a special or annual meeting.
