Re: Complaint against the Western Australian Police.
Dear Mr McKechnie,
I have been writing to you over the past 18 months and as yet I have not received a reply. I am unsure whether you are ignoring my email as I believe I may be being blocked from contacting you by Mr David Robinson. For this reason I have asked Mr Quigley to contact you on my behalf.
I wish to point out that Mr Robinson was responsible for apologizing to me for the standard of the report into my complaint against Western Australian Police made by the Corruption and Crime Commission. The Parliamentary Inspector to the CCC Hon Murray QC found Mr Robinson's report to be incorrect in law. Please find the letter from Hon Murray attached. During investigation by the CCC, at no stage was I contacted to supply further information. The CCC accepted Police reports that have also been found incorrect in law, and don't even correspond to CCTV footage.
My question to you is given the investigation by the CCC and police reports have been found to be incorrect, how can the report be accepted by the CCC?
Ms Linda Black QC advised me that you have the power to correct this situation under section 3 of the Corruption and Crime Commission Act, “reviewable police action”, which is defined as follows:
Any action taken by a police officer that is-
1. contrary to law; or
2. is unreasonable, unjust, oppressive or improperly discriminatory; or
3. is in accordance with the rule of law or a provision of an enactment of practice that is or maybe unreasonable, unjust, oppressive or improperly discriminatory; or
4. is taken in the exercise of a power or discretion and is so taken for an improper purpose or irrelevant grounds or on the taking into account of a relevant consideration; or
5. is a decision that is made in the exercise of a power or a discretion and the reasons for the decision are not but should be given.
It appears that the Police's action is reviewable on all 5 points.
