Why does this petition matter?

 

In order to protect and advance this fundamental right inside our educational institution, it is essential to draw attention to a significant issue involving freedom of expression on the premises. 

Freedom of expression is an essential aspect of a well-rounded education. It enables students to express their identity, thoughts, opinions, and ideas openly, fostering critical thinking, creativity, and the development of independent perspectives. It plays a vital role in creating an inclusive and intellectually stimulating environment that prepares students for their future roles as informed citizens and leaders. While we acknowledge that the school has rules and regulations in place to ensure discipline and order, it's equally necessary to achieve a balance that permits the unrestricted expression of ideas.

It is fundamental to establish a balance between preserving an open and safe learning atmosphere and respecting each person's rights. While it is acceptable for students to express their gender identity, they must do so in a way that complies with any rules and regulations established by the school that are intended to prevent harassment, discrimination, and disruption.

In many different countries, laws and regulations are progressively being passed to protect the civil liberties of LGBT students.

  • Students may be allowed to use the restroom depending on their identity.
  • Participate in activities under these standards in line with their gender identity. 
  • Schools may set a dress code that acknowledges students' gender expression.

Thus, Schools should adopt inclusive policies and practices that promote a safe and inviting atmosphere for all students while supporting and respecting the children's gender identities. 

However it's important to keep in mind that the right to freedom of expression has limitations, particularly in a school environment. Schools are permitted to place reasonable restrictions on student expression when it endangers the rights of others or affects the learning environment. For instance, under the guise of freedom of speech, sexist remarks, violence, or any other form of speech that promotes prejudice or harm towards others is not protected.

Provided with this article is how the students at Tabaco National High School in the 2022–2023 school year responded to fostering the freedom to express themselves.

The freedom to express oneself authentically is a basic human right. Every individual deserves the right to express their gender identity without fear of discrimination, harassment, or bullying. Unfortunately, gender expression is still a major issue in many educational institutions today. Students who do not conform to traditional gender norms often face ostracism and discrimination, leading to an unwelcoming and unsafe environment for them. Such hostile and unfriendly settings have been found to have detrimental effects on the mental health, academic performance, and overall personal development of affected students. It is therefore imperative that schools implement policies and practices that promote freedom of gender expression and protect students from discrimination, harassment, and bullying.

 

 

 

 

However, the survey found that a majority of gender non-conforming students have not been given the freedom to express their gender identity within the school premises (figure 2.) 

Meanwhile, students should be able to express their gender identity freely and comfortably within school premises. Yet, many transgender and gender non-conforming students face significant obstacles to doing so. Dress codes, locker rooms, and bathrooms can all be a major source of distress for students who do not conform to traditional gender norms. Allowing comprehensive access to all school facilities that corresponds to an individual's gender identity can relieve the burden of such fears and anxieties. Transgender and gender non-conforming students should also be able to dress in accordance with their gender expression without fear of punishment or bullying from school administration, teachers, or other students. These steps can significantly reduce incidents of discrimination, harassment, and bullying while creating a safer, more inclusive school environment.

 

 

 

 

Therefore, we demand that schools implement policies and practices that promote freedom of gender expression and protect students from discrimination, harassment, and bullying. These policies should include, but not limited to:

 

1. Allowing students to use the bathroom, locker room, and changing room that corresponds to their gender identity: This means that transgender and gender non-conforming students should be able to use the facilities that align with their gender identity, rather than being forced to use the facilities that correspond to their sex assigned at birth. This can help prevent incidents of harassment or discrimination in these spaces.

 

2. Allowing students to dress according to their gender identity without fear of being punished or shamed: This means that students should be allowed to dress in a way that expresses their gender identity, without fear of punishment or bullying from school staff or other students.

 

3. Providing support and resources, such as counseling, therapy, and gender-affirming health care, to students who request them: Transgender and gender non-conforming students may face additional challenges when it comes to their mental health and physical well-being. Providing access to counseling, therapy, and gender-affirming health care can help support these students and promote their overall health and well-being.

 

4. Including gender identity and expression in the school's non-discrimination policy: This means that the school's policy should explicitly state that discrimination based on gender identity or expression is not allowed, and that students who experience such discrimination will be protected and supported.

 

We believe that everyone has the right to express their gender identity without facing discrimination or harassment. We call upon schools to create safe and inclusive environments that support students in their individuality and gender expression.
