The Issue
Stop the Economic Sabotage and Betrayal of Public Trust!
In Philippines history, Late Chief Justice Renato Corona impeached several articles of impeachment in the concept of betrayal of public trust.
In recent time, the Vice President of the Republic of the Philippines Leni Robredo said to the UN Commission on Narcotic Drugs in Vienna, Austria about "palit-ulo" scheme done by Philippine National Police (PNP) which is not verified. She added, 7,000+ government casualties in anti-illegal drugs campaign, but again is not verified.
In SC defines for the first time ‘betrayal of public trust’, by Ira Pedrasa:
According to Retired Supreme Court Justice Adolfo S. Azcuna, betrayal of public trust that referred to 'all acts not punishable by statutes as penal offenses but, nonetheless, render the officer unfit to continue in office' could be easily utilized for every conceivable misconduct or negligence in office. (2012)
The SC interpreted this simply: “Acts that should constitute betrayal of public trust as to warrant removal from office may be less than criminal but must be attended by bad faith and of such gravity and seriousness as the other grounds of impeachment.” (2012)
Azcuna cited the following as examples of crimes constituting betrayal of public trust: fraudulent act of malversation of funds and falsification of documents. (2012).
Section 2 Article XI- The President, the Vice-President, the Members of the Supreme Court, the Members of the Constitutional Commissions, and the Ombudsman may be removed from office on impeachment for, and conviction of, culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of public trust. All other public officers and employees may be removed from office as provided by law, but not by impeachment.
Betrayal of Public Trust, on the other hand, is a new ground for impeachment, which covers "any violation of the oath of office involving loss of popular support even if the violation may not amount to a punishable offense." (De Leon, Philippine Constitutional Law, 1999, Rex Printing Company, Inc., p.757)
