Pass the Virginia Amendment: End Immunity for Jeffrey Epstein's Co-Conspirators

Pass the Virginia Amendment: End Immunity for Jeffrey Epstein's Co-Conspirators
The Issue
The Virginia Amendment: Justice without delay, accountability without immunity.
In 2019, a federal judge ruled that prosecutors broke federal law when they gave Jeffrey Epstein and his unnamed co-conspirators immunity while deliberately hiding the deal from victims. Despite this confirmed violation, the court couldn't provide meaningful justice. Congress can fix this.
The Problem: A Corrupt Deal Protected Child Traffickers
Jeffrey Epstein's 2008 plea deal was one of the most corrupt prosecutorial decisions in American history:
- Federal prosecutors violated the Crime Victims' Rights Act by negotiating in complete secrecy
- 36 victims were deliberately excluded from plea negotiations
- Immunity was granted to ALL "potential co-conspirators" - unnamed and unlimited
- A 53-page federal indictment was buried that could have resulted in life sentences
- Only 13 months in county jail with work release privileges 12 hours a day
Federal Judge Kenneth Marra ruled in 2019: "The Government violated the Crime Victims' Rights Act when it failed to confer with Petitioners prior to entering into a non-prosecution agreement with Jeffrey Epstein."
The Solution: The Virginia Amendment
Named in memory of trafficking survivor and advocate Virginia Giuffre, who died by suicide in April 2025 after years fighting for justice, this amendment would:
✅ Allow federal judges to void illegal plea deals that violated victims' rights in child exploitation cases
✅ Apply retroactively to the Epstein deal and similar cases where prosecutors broke federal law
✅ Create accountability for prosecutorial misconduct while preserving judicial discretion
✅ Focus narrowly on child exploitation cases to prevent abuse of the law
✅ Require court findings of actual violations - not automatic voiding
Why This Is Constitutional and Legal
- Courts already have authority to void plea deals obtained through misconduct
- Ex Post Facto protections don't apply to remedial measures that benefit victims
- Congress has passed retroactive criminal justice reforms many times before
- Narrow scope and judicial safeguards prevent prosecutorial interference
This Is Bipartisan
Republicans should support this because:
- Targets elite immunity and "deep state" protection
- Allows prosecution of wealthy criminals who got sweetheart deals
- Holds government prosecutors accountable for breaking federal law
- Protects children and families from traffickers
Democrats should support this because:
- Empowers victims of sexual violence
- Creates accountability for prosecutorial misconduct
- Aligns with #MeToo movement principles
- Ensures no one is above the law
If Congress passes the Virginia Amendment:
- Victims can petition federal courts to review the Epstein deal
- Courts can void immunity provisions for those who trafficked children
- Prosecutors can choose whether to bring charges based on available evidence
- Future violations are prevented by creating real consequences
This doesn't guarantee prosecutions - it restores the POSSIBILITY of justice that was illegally taken away.
The Choice Is Simple
Every member of Congress must answer one question: Do you believe victims of child sex trafficking deserve justice, or do you believe powerful people should stay protected by illegal plea deals?
There is no middle ground. A vote against the Virginia Amendment is a vote to protect Jeffrey Epstein's co-conspirators.
Sign This Petition and Demand Congress:
- Introduce the Virginia Amendment in both House and Senate
- Hold hearings featuring victim testimony and legal experts
- Vote YES on giving judges power to void illegal plea deals
- Honor Virginia Giuffre's legacy by fighting for survivor justice
Virginia Giuffre spent 15 years fighting for justice. Her death cannot be in vain.
