Fire and Prosecute PPD's Edwin Dumaguindin for the Homocide of Anthony McClain

The Issue

Officer Edwin Dumaguindin shot and killed Anthony McClain on August 15, 2020.

There was no reason for this to happen. Anthony was pulled over with his friend for not having a front license plate. His friend, the driver, was asked to leave the vehicle. Then, for an unexplained reason, Anthony was also asked to leave the vehicle. Anthony was the passenger in the vehicle, there was no reason for Edwin Dumaguindin to ask him to leave the vehicle.

By asking Anthony to leave the vehicle, Edwin was violating his own police department's protocol. Edwin should have never asked Anthony, as the passenger, to leave the vehicle. Edwin's focus should have remained on his partner and the driver. Instead, Edwin broke the rules of conduct, and put all four men at risk. Edwin's misconduct in the protocol shows he was not judiciously exercising his role as a peace officer (per AB 392) . Within moments, as Anthony ran away, unarmed and in fear, Edwin immediately started firing at Anthony's back, then he and his partner continued to detain and handcuff him while Anthony bled out on the floor.

According to records, the ambulance didn't arrive for 17 minutes, even though additional police officers were able to arrive within minutes in full force. The fire station is only 2-3 blocks from where Anthony was killed. This shows a complete lack of respect for human rights and dignity (AB 392). Edwin and his partner were more concerned in finding a supposed gun (which the victim clearly stated he did not have) than to help the dying man with medical attention.

Officer Edwin Dumaguindin claimed Anthony had a gun. PPD released a narrated and heavily edited video in which they falsely assume his gold MK (Michael Kors) belt is a gun. Anthony had no gun in the video footage. Anthony stated he did not have a gun multiple times. It also showed the officers searching for a gun in the neighbors yards, up the street, down the street, on the opposite side of the street. The footage did not show when the officers eventually “found” a gun on the opposite side of the street where they had previously searched. Fingerprints on the gun still have not been released over one month later, when such a test could be done in 3-5 days.

Edwin Dumaguindin should be charged and prosecuted with homocide charges just as any citizen, especially since California's Assembly Bill 392 has amended the State's use of force penal code. Edwin Dumaguindin was excessive in his use of force to wrongfully and tragically murder Anthony McClain. 

Per AB 392:

Section 835a. , Use of Force Penal Code:

"... declares all of the following:

(1) That the authority to use physical force, conferred on peace officers by this section, is a serious responsibility that shall be exercised judiciously and with respect for human rights and dignity and for the sanctity of every human life. The Legislature further finds and declares that every person has a right to be free from excessive use of force by officers acting under color of law."

-Fire Edwin Dumaguindin.

-Prosecute Edwin Dumaguindin.

-Do NOT provide Edwin Dumaguindin with compensation once he is fired.
