Create regulatory framework for the aerial drones

Considering that the aerial drones represent excessively high risk of abuse and misuse, that they move in 3 dimensions unrestricted by the property lines, fences, walls etc and pose a risk of injury and death, where an operator is very difficult to identify and establish contact with, operation of the drones must be regulated by the government of Canada and the specific offenses must be introduced in the Criminal Code of Canada for improper use.

Before authorized commercial exploitation of the drones even began, the drones have injured, sometimes severely, at least 12 people, including gouging an eye of an 18 month old child! This exceeds the car injury rate by several powers of 10. There is a documented case of drug trafficking by drone in Mexico, as well as drone crashing through a high-rise building window and injuring a tenant in South Africa.

Continued unrestricted operation of the aerial drones represents unreasonably high risk of injury, property damage and breach of public safety. As opposed to the cars, that are strictly regulated while only capable of traveling on the roads in 2 dimensions, the drones have no limits and travel in all 3 dimensions. They can enter private property without permission, fly into the windows, ventilation shafts, land anywhere, pick up and drop the objects and perform other actions. That has high potential of criminal misuse up to assault, murder, eavesdropping, theft, contraband of controlled substances, explosives, narcotic drugs, transfer of ransom cash all while the owners and operators are practically impossible to identify and contact.

The design of the drones also makes them extremely dangerous for human health due to the sharp blades rotating at several thousands RPMs on 3, 4 or 6 corners. There is virtually no safe area around a drone! One cannot just wave it off if a drone flies straight at a person.

Continued lax legal regime as regards to possession and operation of the drones has a potential of making continued existence of our society impossible and the proper laws and regulations have to be put in place, just like they were for the motor vehicles and radar detectors.

The drones must be legal to build, import, possess and operate in Canada only if and when:

  1. Drone is of an approved design, including the safety requirements deemed necessary by the aviation authorities (ex. duplicated controls and systems; forced landing protocol accessible to and verifiable by police; forced safe landing when battery is low; provision for preventing flying closer than certain distance from people/animals and avoiding collision with objects, etc)
  2. The drone bears a unique individual number, similar to VIN, registered with the provincial Ministry of Transport.
  3. The operator is licensed and owns an insurance policy covering at least $1,000,000 liability for personal injury and property damage.
  4. There must be a clear process established for identifying and contacting the operator by any 3d party when the drone is still in the air.
  5. It must be a criminal offense to possess a fully autonomous drone.
  6. There must be a speed limit established for the drones.
  7. The operators must not have blood alcohol level exceeding a reasonable figure, similarly to the motorists.
