According to the Texas State Department of Health Services, Dale W. Wilson, a two (2) year Statute of Limitations exists to file a complaint with this specific regulatory agency. Both the Texas Medical Board (TMB) and the US Dept of Health & Human Svcs. have recognized August of 2012 as the date from which the statute time limit should commence. This was when I first became aware, with an admission made by the Defendant(s), that my medical record Dr. Mark Alan Swancutt asked to borrow from me (about 178 pages) was lost or otherwise missing. I originally began asking for its return in April 2011 from Susan Plumlee (Patient Relations Director), with proof in email exchanges with her. After continuous calling and emailing, the Defendant(s) managed to drag their feet for over a year, defaulting on their promise to return it. I began filing formal complaints in 2012. I'd like to know just how long the Defendant(s) were aware my medical record was missing, yet failed to notify me of such.
