

Allow owners choice of service providers at Menlyn Maine Residences
The Issue
Pam Golding marketed and sold the Menlyn Maine Residences apartments to prospective buyers based on the premise that owners will maintain the freedom of choice in who they employ to generate a return on the property investment.
The Menlyn Maine Residence Board of Trustees has since 19 October 2020 enforced Management Rule 30.4 (d) on the short term pool operator Gaya House and its service provider, Guesthouse Hub terminating the right of business by restricting access of its directors and employees to the Menlyn Maine Residences building.
Such a narrow interpretation of this rule would constitute a gross limitation of the individual owner’s right to use and enjoy such units. More-so, it would not be in line with the intention of the parties as contemplated by Rule 30(4)(d).
The Board of Trustees indicated the favorable choice for short term rental pool operator is The Capital without exception.
Not only does this decision infringe on the rights of all owners to have access to service providers of their own choice, but it restricts the fair chance for competition as well as open the door for nepotism, favourism and ultimately corruption in the hearts and minds of the very people who should be protecting the interest of the owners.
Big corporations have the power and capital to bully and discriminate against businesses entering the market. This does not imply small businesses entering the market should be discriminated against.
Every business who offers the highest level of integrity and quality of service to the owners of Menlyn Maine Residences apartments should be given the opportunity to fairly participate in the market.
With this petition we are asking you to sign for your freedom. Freedom of choice, whether you wish to exercise your freedom of choice now or in future.
You as a sectional title owner of the Menlyn Maine Residences maintain the power to exercise your right of choice for operating, managing and maintaining your apartment(s).
