Overturn Unjust Intoxication Manslaughter Conviction

The Issue

Our plea arises from a deeply personal situation. My husband,George Alvarez was wrongfully charged for intoxication manslaughter when he wasn't under the influence at the time of the unfortunate accident. We believe this to be a miscarriage of justice that we aim to rectify. 
Dealing with the tragedy itself was distressing enough, but dealing with a wrongful conviction has added to the emotional toll on our family. My husband is not alone in this fight; according to the Innocence Project, about 2.3% to 5% of all prisoners in the U.S. are innocent (source: Proceedings of the National Academy of Sciences).
 
George Alvarez, was painted as a “racist monster” over the media. He was judged on national television by many critics without even knowing all the facts. The Brownsville police department of Texas has failed my husband before and falsely accused him back in 2005 . George was 17 at the time barely starting off his life, he was sentenced to 8years in prison over a crime he did not commit. George’s life was changed forever. He spent 4 years in prison . His false imprisonment only began to perpetuate trama in his life. He began a lawsuit against the city of Brownsville ;whom eventually never received not even a single dime from .The Brownsville police department of Texas has always had it out for George after his exoneration. On May 7, 2023 George was in an accident . He made world headlines and Brownsville police department had a press conference world wide lying on George’s Criminal history. Earlier that morning George passed a red light. He tried to avoid  hitting a vehicle so, reared off to the side and lost control hitting the curb . Unfortunately running over a group of migrants sitting on the sidewalk waiting for a bus.George then realized he had been in an accident ,he ran to the nearest house to ask for assistance no one answered. He immediately goes back to the scene where he then is beaten by multiple men unconsciously. The police arrive and  the officer turns him over and began to handcuff him without checking his well being. The Leading officer Mr.Rosales never offered a sobriety field test or even questioned him anything . The officer just assumed he was intoxicated. George suffered as well as the victims .The Venezuelan’s fractured his ribs, stomped on his head till he was unconscious ,causing him to have concussion like symptoms. Common symptoms after a mild traumatic brain injury are headache, confusion and loss of memory, known as amnesia. Which explains why George fails to remember anything about that morning.
George was unconscious laying on the hospital bed. That’s when 1 of the 4 officers, who were left with him ,invaded his privacy .They shared a photo with the world . A shirtless photo of him laying on a hospital bed unconsciously went viral. By that time George had been administered morphine. Rn Janet Zuniga , whom drew his blood ,testified on the states behalf and told the jury based on her experience George was intoxicated and  said she “had never experienced anyone on morphine act like he was acting. “Yet morphines symptoms are as listed  dizzy, drowsy, confused, or disoriented. To the world George looked drugged; which he was but do to his injuries. The district attorney argued about George’s past addiction ,but what about that morning? George was off to work with his fr clothes and working boots.George results speak for itself.In America we pray that justice is served , but what about those men whom also beat up George ? Or is it ok for them to beat up George because he committed an accident ? The District attorney of the state of Texas Arturo Tienente said “they did the right thing” is this how justice is served in America ? George accepts full responsibility for that day, except for he wasn’t intoxicated. He was given a urine sample which can indicate a false positive when it comes to drugs. Drugs can stay in your system up to a couple of days. The blood work took months to get back to the Brownsville police department ; in fact it took 7months. The bloods results will then be positive for benzoylecgonine , a inactive cocaine metabolite.  Two toxicologists testified and said there was no way George was impaired at the time of the incident. Due to insufficient evidence the jury found George Alvarez guilty. The state failed to show a very important factor in this case. The video where he was getting beat unconscious . I strongly feel George was cheated by the system again. George is not a monster,George did not commit this crime on purpose.  George is a human being a father and a husband at the end of day,whom committed an accident. He does not deserve to be unfairly punished. He is already having to live with what he has done,it still has damage his life dramatically.                                                            

This is not simply about overturning one man's wrongful indictment, but about standing up against improper judicial proceedings and advocating for the rights of all who might face this injustice.
