The Issue

This is an overstep of authority. People should be able to park their vehicles on property they own and pay taxes on however they see fit, as long as it is not overrun with non operating vehicles. This ordinance is not consistent with desire of the majority of residents. For those residents who do not have a paved drive and can not afford one it is a burden.

ORDINANCE REGULATING PARKING

(Areas Zoned Residential)

No. 2025 -010

AN ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES, TRAILERS, BOATS, AND OTHER VEHICLES IN FRONT YARDS AND SIDE YARDS OF AREAS ZONED RESIDENTIAL (R-1, R-2, and R-3) WITHIN THE

CITY LIMITS OF DE KALB, TEXAS, ESTABLISHING A PENALTY, AND DECLARING AN EFFECTIVE DATE.

WHEREAS, the parking of motor vehicles, trailers, boats, and other vehicles in front yards and side yards of areas zoned one-family and two-family within the City Limits of DeKalb, Texas, creates a traffic risk and nuisance, and the City of DeKalb, Texas, desires to create an ordinance for the regulation of such parking within the city limits of DeKalb,Texas.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DE KALB, TEXAS:

Section 1: It shall be illegal for any person to park or to allow to be parked on any property under his or her control any automobile, bus, truck, motorcycle, motorhome, camper, trailer, boat, or any vehicle (vehicle is defined throughout

as - every device in, upon, or by which any person or property is or may be transported or drawn upon a street or highway, except devices moved exclusively by human power) on any portion of a front yard or side yard of any

area which is zoned "R-1" Residential, "R-2" Residential, or “R-3" Residential or on any premises which is used for one-family, two-family or multifamily dwelling purposes unless:

(a) Such area is a part of a hard-surfaced (hard-surfaced is defined throughout to include cement, asphalt, brick, and other commonly accepted pavement) driveway or parking area;

(b) Such area is a part of a gravel driveway bordered by cement curbing or similar permanent border;

(c) Such area is a part of a required driveway that provides access to a garage, carport or off-street parking area; or,

(d) Such area is part of a side yard which is enclosed by a screening fence at least six feet in height and so constructed that no person can see through into the area surrounded by the fence.

Section 2: The terms of this section shall not be construed to apply to the parking of vehicles in a front yard or side yard where such parking is permitted in conjunction with temporary special events open to the public which may be

designated from time to time by the city council.

Section 3. Any person violating any provision of this section shall be deemed guilty of a misdemeanor and, upon conviction, in the municipal court of the city, shall be

fined not more than $500.00. Each day of any such violation shall be deemed to be a separate offense.

Section 4. This Ordinance shall become effective from and after its adoption and publication as required by law.
