Overhaul the Nursing and Midwifery Council for Greater Legal Accountability

The Issue

On 9 July 2024 a recent Independent Culture Review showed the Nursing and Midwifery Council (NMC) to be an organization that exists in a toxic, racist and bullying environment with failings in safeguarding. The report indicate that there is a link between the NMC regulatory performance and its culture. This I believe to be correct. For 12 long years, I have suffered the brutality of the toxic, racist, bullying and harassment behaviour by this regulator. From 2012, the NMC has continued to breach its own legislation the NMC Order 2001. It has kept me stripped of my registration by the failure to deal with my applications for restoration. This illegal conduct has kept me off the nursing register despite a successful Employment Tribunal (ET) claim for discrimination against the referrer, North Bristol NHS Trust (the Trust).

The ET findings showed that I suffered unlawful victimization by the referral made to the NMC in a decision dated 15 April 2011. The Trust further admitted in a letter sent to the NMC dated 9 November 2011, that its witnesses gave false evidence to the CCC Panel which the ET held may have contributed to my striking off. In October 2011, I was awarded compensation for injury to feelings. Inspite of this legal triumph, the NMC's inherent bias and discriminatory culture has acted to the contrary of the NMC Order 2001 by its failure to deal with my applications for restoration, leading to my career's indefinite suspension.

I believe the Toxic culture within the NMC has allowed it to misuse its regulatory powers by violating its statutory duty to comply with Articles 30(7) and 33 of the NMC Order 2001, in preventing me from exercising my legal rights as a registrant under these legislations to seek to return to the register. In doing so, the NMC joined forces with the Trust to instruct a team of lawyers to pursue me in the High Court to prevent me from complaining about this unlawful conduct. These legal proceedings are continuing today. There is no doubt that I have been a victim of the NMC's toxic, racist and discrimination culture which I believe runs through the organization from top to bottom. 

The NMC is currently under public scrutiny for its exposed racism and discrimination culture, putting its actions at odds with the principles it's meant to uphold. It's clear that change is needed to ensure fair treatment of all registrants and for the NMC to be compliant with its statutory obligations. This is not just a personal battle; it's a matter of legal and professional ethics that affects the nursing and midwifery community as a whole. We can't ignore how entrenched discrimination and bias compromise the integrity of this regulatory council. These controversial patterns in the NMC's decisions and actions raise valid concerns over its management's capability and suitability as a regulator in its present form.

Therefore, we demand the disbandment of the NMC’s present management, to be replaced by a more accountable and legislation-compliant body. The NMC's toxic culture, lack of fairness and disrespectful conduct towards nurses have resulted in extreme psychological suffering with nurses losing their lives by suicide. The outcome of the Independent Culture Review conducted by Nazir Afzal OBE and Rise Associates show that since April 2023 six nurses have died. I, myself have endured immense distress and loss of my career due to the NMC's unlawful discrimination and breach of the NMC Rules. The intention was to keep me struck off indefinitely and bring an end to my nursing career. I am certain that had I not been a strong character I would not be here today. We therefore must challenge the government and relevant governing bodies to start the needed systemic change within the NMC starting from the top.
