As requested, we have provided responses to the questions below within the week.  One of our team members is not available within this time frame and as you will see below this means some questions will be answered at a later date.

 

Permitted Development and Prior Approval
We understand that installation, alteration and replacement of relevant apparatus, ancillary development, and temporary placement of movable apparatus is covered in permitted development rights and requires a prior approval application.
Please confirm whether the proposed installation is being advanced under permitted development rights alone, or whether an application for prior approval has been or will be submitted to the local planning authority.
 

In answer to the two questions above: we are using the permitted development rights to provide planning permission for the proposed site at Warick Gardens.  I have attached a factsheet on town and country planning and telecommunications sites for your information. 

 

If any application has been submitted, please provide the application reference number and details of how residents may make formal representations.

Design, Siting and Appearance
The image provided within the formal notification is not clearly readable. 
Please provide detailed plans, drawings, and supporting material showing how the equipment will be sited, designed, and screened to minimise visual and environmental impact.
 

In response to the two questions above:  Please find the drawings for the proposed site attached to this email.  These show the location, scale and form of the proposed three pole mounted antennas, dishes and rooftop based radio equipment cabinets.  The proposed equipment is of the minimum scale required to allow this site to be operationally efficient. The use of any form of additional screening would make the development more prominent due to the size of screening that would be needed to encapsulate the proposed equipment.

The development is out of scale on a small block of flats and a lot of equipment will be crammed onto the roof.  The highest element has no height given, but it must be 6m.  This is a huge amount proportionately to the height of the existing building.  We recognise that an attempt has been made to keep the visual impact to a minimum, but the minimum is not acceptable visually
The highest part of the development, which are the antenna support poles, will be approximately 4.5m above the main roof level.  The proposed development is of the minimum scale possible to provide effective services to the local area.  

 

Please also confirm what assessments (if any) have been undertaken on structural capacity and building safety.
 

Building and Structural surveys and calculations have been undertaken as part of the formalisation of the finalised design scheme.

We would like more information around which other sites have been explored and why they were not considered appropriate.  There is a high-rise development being built directly behind 67-109 Warwick Gardens and the hospital building just behind that.  Siting of equipment there (from whence it came) would surely be more appropriate and more in scale.  Or on the existing hospital site, behind the development
The specialist team member who undertook the local search is presently on leave and as such this information will follow as soon as possible.  Thank you for your patience.

Consultation and Statutory Duties
Please identify the statutory basis for your notification and explain how you have complied with consultation requirements under the Electronic Communications Code.
 

The proposed development is permitted development via its siting and design in adherence to the requirements and conditions of Part 16 of the General Permitted development order and the Electronic Communications Code. Consultations have been undertaken in line with these and the Electronic Communications Code of Practice as detailed upon the attached Consultation Plan.

 

Please clarify how the views of leaseholders and residents will be considered before any agreement with the freeholder is finalised.
 

We suggest that this is a question for the Council and its agents to respond to.

 

Impact and Access
Please specify the proposed method of access for installation and maintenance, and what safeguards will be in place to prevent disruption to leaseholders’ use and enjoyment of the property.
 

Access will be via the existing designated roof/plant room access from the main access stairwell.  Please clarify how you feel the proposed equipment will disrupt leaseholder’s use and enjoyment of the property.

 

Please confirm who will be responsible for damage, increased service charges, or insurance costs arising from the installation.
 

The lease agreement between Cornerstone and the Council will provide details of all financial arrangements associated with the development.  

 

 

Financial and Other Benefits
Please confirm whether the landlord (the Council) will receive financial consideration in return for granting rooftop rights, and whether any of these benefits will be shared with leaseholders or reinvested into the building.
 

We suggest that this is a question for the Council and its agents to respond to.

We would like more information on how and when any proposed works would be carried out, and how residents' would be protected from disruption both from installation and future maintenance.   Will any works have potential for affecting residents' future service charge?
The build works will be carried out as sensitively as possible, if you have any requests regarding the build e.g. working hours please let us know so we can consider them.  With regard to the service charge we suggest that this is a question for the Council and its agents to respond to.

 

Meeting with Developers
We request a direct meeting with your project team to discuss the proposal in detail and to allow residents the opportunity to ask questions. We have already met with the Council in August, and they advised that they would request such a meeting with you, as many of our questions could not be answered by them.


Please provide proposed dates for such a meeting within the consultation period.
We would also like to know who residents will be able to contact about concerns and questions during the process.  As all e-mails since 2022 have been ignored this is very important.
