PETITION IN OPPOSITION TO PROPOSED ANNEXATION OF U.S. ROUTE 60 THROUGH CULLODEN, WEST VIRGINIA

The Mayor and Town Council of the Town of Milton, West Virginia

And all reviewing or supervisory authorities with jurisdiction

 


We, the undersigned residents, property owners, business owners, and stakeholders of Culloden and the surrounding unincorporated areas, respectfully submit this petition in formal opposition to the proposed annexation of U.S. Route 60 and any associated rights-of-way by the Town of Milton.

 


Basis for Opposition

 


The proposed annexation raises substantial concerns regarding statutory compliance, resident consent, and the principles of equitable municipal governance. Specifically:

 1. Absence of Community Consent

The annexation has not been initiated by petition of affected property owners or residents and does not reflect the demonstrated will of the community subject to its effects.

 2. Improper Corridor Annexation

The annexation of a transportation corridor without the meaningful inclusion of the surrounding community undermines contiguity, community integrity, and established norms of municipal expansion.

 3. Regulatory and Financial Impact Without Representation

Annexation of a roadway may subject residents, commuters, and businesses to municipal regulation, enforcement, or taxation without corresponding representation or municipal services.

 4. Prejudicial Effect on Future Self-Governance

This action may impair Culloden’s ability to pursue future incorporation or cohesive planning by fragmenting jurisdictional authority.

 5. Insufficient Public Process

The affected community has not been afforded adequate notice, transparency, or opportunity for meaningful participation prior to advancement of the proposed annexation.

 


Requested Relief

 


We respectfully request that the Town of Milton:

 • Decline or withdraw the proposed annexation of U.S. Route 60;

 • Refrain from annexation actions lacking clear community consent;

 • Engage affected residents in a transparent and inclusive public process.

 


This petition is submitted in good faith and with full respect for municipal authority, while asserting the rights of residents to fair representation and local self-determination.
