I have been a proud landlord on the east side of Syracuse for 30 years, dedicated to providing quality housing without exorbitant rent increases. However, the proposed Good Cause Eviction (GCE) legislation threatens to disrupt the delicate balance between tenant rights and the viability of property management. This legislation, while seemingly aimed at protecting tenants, could inadvertently lead to negative outcomes for both landlords and tenants.
Good Cause Eviction, as proposed, could lead to unintended consequences. It affects landlords' ability to manage their properties responsibly and forces them into a position where annual rent increases are necessary to maintain property values and equity for future sales. Additionally, our community already benefits from robust tenant protection measures. For instance, Section 233-b of the New York Real Property Law prohibits landlords from retaliating against tenants who report housing issues, ensuring tenants can speak out without fear of repercussions. Moreover, there is free legal assistance available exclusively for tenants at the courthouse, providing a safety net for those who need it most.
Moreover, the NYS 7-D, enacted in 2023, empowers tenants to sue for necessary repairs, ensuring landlords maintain adequate living conditions. These existing laws adequately protect tenant rights while allowing for fair management practices by landlords.
Despite these protections, the introduction of GCE could detract from the positive developments. Forcing landlords to perpetually increase rents to avoid being squeezed out of the market undermines the very goal of creating affordable housing and may have ripple effects throughout neighborhoods, causing instability and increased displacement. The proposed law could ironically lead to rent hikes, scarcity of available units, and a reduction in the quality of housing due to the financial strain placed on landlords.
We urge the local government and community stakeholders to reconsider the implementation of Good Cause Eviction in Syracuse. It's crucial to strike a balance that considers the needs of both tenants and landlords, fostering an environment where quality, affordable housing is accessible without inadvertently pressuring landlords into detrimental practices.
