Egregi On. Alfano e Dott. Renzi,

la tassazione dei prodotti "succedanei del tabacco" è una cosa ingiusta e assurda. Si vuole distruggere un settore che crea posti di lavoro, che salva vite umane, che fa risparmiare soldi (molti) alla sanità pubblica e tutto per sostenere la lobby del tabacco. Abbiamo chiesto all'on. Giorgetti - delega ai monopoli - e all'Agenzia dei Monopoli di Stato di fare qualcosa ma non ci sentono. 
La tassazione deve rimanere nonostante sia palesemente anticostituzionale e che la stessa AAMS riconosca di non essere in grado di gestirla.

AAMS non ha procedure adatte ai prodotti semidurevoli,  (come tutta l'accessoristica e le batterie); mancano sistemi di gestione dei ricambi non a catalogo produttori, perché le sigarette al tabacco non hanno bisogno di ricambi e non si rendono per malfunzionamento. Non è ancora chiaro come dovrà essere gestita l'IVA. E così via su decine di altri problemi cui non è possibile dare risposta perché i settori sono troppo differenti.

Non è possibile applicare al nostro settore una normativa per prodotti completamente diversi: perché è come volere applicare le norme che regolano l'igiene delle stalle alle sale operatorie degli ospedali e pretendere che si adattino perché entrambe sono "locali" o "stanze".

Inoltre nessun prodotto o settore di mercato può affrontare un incremento di 2,41 volte il prezzo di un prodotto come richiede la legge. Non si riesce a digerire un punto di IVA, figurarsi un raddoppio e mezzo del prezzo.
Sembra che nessuno abbia pensato che una tassa del 58,5% richiede l'aumento di 2,41 volte il prezzo. Ed è facile da verificare:  
100 x 2,41 = 241
241 -  58% = 100
Per mantenere il margine precedente, un normale margine commerciale, con la nuova accisa si deve moltiplicare il vecchio prezzo per 2,41. Ma vi sembra logico ? Purtroppo la matematica non è un opinione e chi ha scritto la legge non la conosce. 
Oppure è in malafede e questa legge è stata scritta con l'intento di distruggere il settore.  

On. Alfano e dott. Renzi, converrete con noi che un simile regime di prezzi significa la chiusura del settore: non è possibile pagare oggi 120 Euro quel che ieri pagavi 50. Non è possibile sopravvivere se di quei 120 euro lo stato se ne tiene l'80%. Non è equo, non è serio, non è giusto, non è dignitoso.

In tutto il mondo lo "svapo" è libero. In paesi come la Svizzera e l'Australia si pensa la messa al bando del tabacco a favore della sigaretta elettronica. Qui, al pari dei paesi del terzo mondo, la lobby del tabacco riesce a fare passare una legge iniqua e punitiva.
E' evidente che questa legge sia stata fatta per colpire il nostro settore in modo definitivo. Un settore in crescita e che crea lavoro e PIL in un momento in cui ce n'è molto bisogno. Un settore che garantiva più di 5000 posti di lavoro.

Ma c'è di più, purtroppo.
On. Alfano, dott. Renzi, vi prego di chiedervi quanti tra i vostri amici, familiari, conoscenti stanno usando una sigaretta elettronica invece delle sigarette al tabacco e di pensare che ne sarà di queste persone quando saranno costrette a tornare alle sigarette vere perché tutte le aziende - dai negozianti ai produttori - saranno stati costretti a chiudere, per disaffezione del pubblico motivata dai prezzi assurdi a causa di questa iniqua "accisa". 
In questo paese non si era mai vista una simile oscenità fiscale: non si era mai vista una nuova tassa che colpisse un settore con il 58,5% di imposizione.

Chiedo a voi di abrogare questa assurda e illiberale tassa e di non permettere che quasi un milione di persone, tra svapatori convinti ed occasionali, ritornino definitivamente al tabacco assassino.
Ve lo ricordo, se ce ne fosse bisogno, che l'anno scorso, vi sono stati - a detta del Ministero della Sanità - circa 85.000 morti per causa delle patologie direttamente connesse o aggravate dal consumo di tabacco nel nostro paese.

Restituite dignità e forza all'unico strumento che può cambiare qualcosa nelle tragiche statistiche di morte per tabagismo in Italia. 
Restituite una speranza alle centinaia di migliaia di persone ex fumatori.

To mr. Matteo Renzi, Secretary of the Democratic Party

Dear Sirs,
the new tax over the "products substitute of tobacco" is absurd and unfair. This law will destroy a market segment with creates new jobs, saves lives and makes the Public Health to save (a lot of) money. This law has been filed to support the lobby of tobacco producers. We have asked to the honourable mr. Giorgetti – who is the sub secretary with Delegation for Tobaccos and Gambling at the Ministry of Finance and to the State Monopolies Agency (AAMS) to do something, but they have no ears for this. In their wish the new tax must remain in force, notwithstanding the Agency is admitting that they are not capable to manage all the problems that it rises.

AAMS has not the procedures suitable for the semi-durable products (as all the accessories, the batteries, the bags etc); they lack in management of the parts not in the producers catalogs and require authorizations for the replacements, because the common cigarettes have no need of spares and they do not suffer of malfunctioning. Also it is not clear how the VAT tax shall be managed on the final prices. Ant it is the same chaos on dozens of other problems, on which is not possible to find answers because the tobacco and the e-cig sectors are completely different.

It is not possible to apply to our sector the regulation of products that have nothing to do with ours: it should be like someone who would apply the rules of the stables to the surgery rooms only because both are "rooms".

Also no product nor any market sector can afford an increase of 141% on the selling prices with hope to survive. The market cannot easy digest an increase of one point of VAT tax, and definitely will not accept more than a doubling of it.
It seems that nobody has thought that a tax of 58,5% requires an increment of 2,41 times the original price. And it is easy to verify:
100 x 2,41 = 241

To keep the previous normal commercial margin with the new tax all the prices must be multiplied by 2,41. Does this seem logic to you ? Unfortunately mathematics seems an  opinion to those who have written this law. Or they were in bad faith, and they did it with the precise intent to destroy the e-cig market in Italy.

Honourable Mr. Alfano, dear Dott. Renzi, you will agree that this price regime means the end of this sector. It is not possible to pay today 120 Euros what yesterday was paid 50 Euros. Also it is not possible to survive if the State will keep the 80% of those 120 Euros. It is not right, not fair, not serious, not decent.

In the rest of the world vaping is free. In many countries the lobby of tobacco is actively trying to obstacle the e-cig. In countries like Switzerland and Australia they think seriously to banish tobacco cigarettes in favour of the electronic vaping systems. Here, as well as in the third world countries, the tobacco lobby was able to file such  iniquitous and punishing law.
It is almost clear that this tax has been designed to destroy our sector definitively. A sector in good health which creates jobs and gross product now, when there is such a need of both. This sector was granting more than 5000 jobs, and it was growing.

But unfortunately there is more.
Honourable Mr. Alfano, dear Dott. Renzi, I ask you to ask yourself how many friend of yours, relatives and kins are using some e-cig device instead of smoking tobacco cigarettes, and also to think about what will be of these people when they will be forced to return definitively to the tobacco.

They will do it, because there will not be any more companies – from shops to importers to producers – to distribute e-cigs: all these companies will be forced to close because the disaffection of the public, caused by this absurd "tax" that will rise the prices in this unacceptable way.

In this country we have never seen such an fiscal obscenity: we have never seen a new tax to hit a sector with a 58,5% of new imposition.

I ask you to revoke this absurd and illiberal tax to not allow that almost a million people – from regular to occasional vapers – will return definitively to the tobacco killers. I recall you, if there is the need, that according to the data of the Ministry of Health, almost 85,000 people have been dead by diseases directly connected or aggravated by the tobacco consumption in our country in 2012.

Please repay dignity and strength to the only instrument that can change something in the tragic death statistics of the smoking in Italy.
Please repay a hope to the thousand of former smokers of our country.
