Objection to Nareg Gourjian

Re: THE PEOPLE OF THE STATE OF CALIFORNIA, PLAINTIFFS, VS. CONRAD ROBERT MURRAY, DEFENDANT, Case No. SA073146

 

 

Dear Honorable Judge Pastor:

 

We humbly request that your honor intensely consider the appointment of Nareg Gourjian to the Conrad Murray defense team. It has already been mentioned that there is indeed a very possible conflict of interest here. In all actuality as you have stated your honor—the fairness and loyalty of Nareg Gourjian should extend to his former client, even if he is deceased.  This is part of the rules that must be obeyed by all attorneys.

 

Being that this is the case--not only should Nareg Gourjian withdraw his application for consideration to be on that defense team--he should face possible disciplinary action from the California State Bar should he pursue this course of action. This does not appear to be an ethical situation from any perspective. In light of the aforementioned, we do indeed question the legal tactics of Mr. Gourjian. Moreover, for Mr. Gourjian to even have even considered himself eligible for such an appointment to the defense team is unfathomable.

 

Junior partner or not--Mr. Gourjian indeed, more than likely not, has good knowledge regarding the victim and quite possibly information which could be potentially damaging to the prosecution. By all accounts this information should be kept confidential-- it is part of a private former case record.  We do not agree that as a junior partner Mr. Gourjian did not have any desire to view the entire contents in that case file. As such from recollection this was a case that many attorneys would have wished to access for the sheer legal complexities and nature of it—coupled with the furtherance of career goals (THE PEOPLE OF THE STATE OF CALIFORNIA, PLAINTIFFS, VS. MICHAEL JACKSON, DEFENDANT, CASE NO 1133603). Mr. Jackson was exonerated in this case and it should not be allowed to haunt him even in death.

 

We do think that this act is nothing but a calculated move by the defense team of Conrad Murray--a super imposed tactic to acquire some leverage and advantage over the prosecution by having inside information regarding the victim Michael Jackson. To allow this kind of unethical violation to take place would pave the way for the future of this trial. Thus this would indeed make a clear statement regarding justice and what is permissible here. In light of the severity of the aforementioned facts we humbly request that you not allow Mr. Gourjian to be a member of the defense team--by citing the strong possibility of an existing conflict of interest and a prejudicial affect to the prosecution.
