Dis-ban the "Enforcement Committee" in the Oakbrook Community HOA, St. Augustine Fl
The Issue
I propose that we dis-ban the "Code Enforcement Committee" committee for the good order and positive relationship of our members. The board and the management company should be the ones tasked with reporting, documenting, and notification of violations within the community.
I further propose that all violations reported to the management company require disclosure of the individual making the complaint to accompany the notice of violation to the member. This language should mirror that of the newly passed Fl Senate Bill 60, signed into law on June 29, 2021. This new legislation prohibits code inspectors from initiating investigations of potential violations of codes and ordinances by way of anonymous complaints. It also requires persons reporting potential violations to provide contact information before an investigation occurs.
In accordance with Florida Statute 720.303(2)(d) If 20 percent of the total voting interests petition the board to address an item of business, the board shall at its next regular board meeting or at a special meeting of the board, but not later than 60 days after the receipt of the petition, take the petitioned item up on an agenda.
