Dear Coroner Teresa O’Sullivan,
I acknowledge receipt of an undated letter signed by Ann Lambino, Registrar along with a copy report dated 1 October 2020 addressed to Magistrate Baptie which is totally irrelevant . You failed to address any of the issues outlined in my letter of 27 April, 2020 nor did you answer any of the questions in my email of 17 May 2020 The negative response to such a serious matter and that is the death of my son, Adam Cecil was of no surprise to me due to previous unfavourable contacts associated with the Coroners Court.
- Collusion within the Coroners Court was brought to my attention on 19 July, 2006 in a letter from Tony Stewart MP, Parliamentary Secretary for Police and I quote “Detective Sergeant Donna O’Mally of Miranda Local Area Command has advised me that, following a complaint made by Ms Cecil to the NSW Ombudsman (Bruce Barbour) about the initial investigation into her son’s death by Senior Constable Massey, which suggested the matter was a suicide, Deputy State Coroner Jacki Milledge forwarded a letter to the Ombudsman in support of the police investigation. The Ombudsman subsequently declined Ms Cecil’s complaint”.
- Attorney General’s Department, John Feneley, Assistance Director General (Legal Services) Letter dated 25 October 2006 and I quote “Mr Michael Littlejohn, Acting Manager Coronial Services NSW, informs me that the Acting State Coroner, Magistrate Jacqueline Milledge, has indicated that an inquest will be conducted into the circumstances surrounding the death of your son. As Her Honour had supported the Police Officer in charge of the investigation when you previously raised your concerns with the NSW Ombudsman a note has been placed on the file that she will disqualify herself from further dealings with this Inquest.
- Deputy State Coroner Paul MacMahon handed down his findings on 1/2/2008 Adam Cecil died on 3 August 2005 at Sutherland Hospital. His death was the result of multiple injuries sustained when he jumped from the roof of 3 Ozone Street, Cronulla with the intention of taking his own life.
- Deputy State Coroner Paul MacMahon handed down the above findings with absolutely no evidence that Adam had climbed onto the roof of 3 Ozone Street, Cronulla
- Following the Inquest held under the carriage of Deputy State Coroner Paul MacMahon I contacted Inspector Rodney Leslie RAE who attended the crime scene on the night Adam died. We later met and Inspector RAE subsequently made representation to the Coroners Court on my behalf outlining new evidence with reference to the old paling fence that Adam had possibly been assaulted and thrown over to where his body was found.
- I was then to receive a letter dated 23 June 2008 directly from Brigitte Bucek A/Registrar, State Coroners Court and I quote ”State Coroner, Magistrate Jerram has considered your letter and reviewed the file. She concludes no reason to re-open the Inquest of Deputy State Coroner, Magistrate MacMahon, the allegations made is not further information”. This is definitely UNTRUE
- Under Section 85 of the Coroner’s Act the Supreme Court of NSW Judge Hidden handed down his finding on 4/10/2012 Findings of coroner quashed, new inquest ordered
- Deputy State Coroner HCB Dillon in the second Coronial Inquest on 29/8/2013 I find that Adam Cecil died on 3 August 2005 at Sutherland Hospital, Miranda, New South Wales as a result of multiple injuries suffered due to a fall from height. I am unable to determine how that fall came about.
- Having inspected the Cronulla crime scene, Deputy State Coroner H.C.B Dillon was well aware that there was nowhere for Adam to fall/jump from
- And why did I say the Report addressed to Magistrate Baptie is totally irrelevant? Simply because there was nowhere for Adam to fall/jump from.
I believe due to the insufficiency of enquiry in the second Inquest under the carriage of Deputy State Coroner HCB Dillon makes it necessary and desirable in the interests of justice to hold a fresh inquest which is definitely of public interest. I await your favourable reply.
